(A) No development approval shall be issued unless the requested use conforms to:
(1) A site plan that is approved as part of a rezoning to an “MX” (Mixed Use) District; or
(2) The regulations that apply to the use pattern that is requested. (See §§ 153.0130 through 153.0140 and 153.0155 through 153.0166 of this chapter.)
(B) A TND (§§ 153.0130 through 153.0140 of this chapter) or transit-oriented development (TOD) (§§ 153.0155 through 153.0166 of this chapter) is permitted in an “MX” (Mixed Use) District as of right.
