(A) The contractor that has the current exclusive trash service contract (hereinafter referred to as “contractor”) is hereby designated as the sole contractor within the city limits for the purpose of operating a pickup and disposal service for all trash and refuse within the city.
(B) All residents and businesses or their landlords within the city shall subscribe to the service, and comply with and be subject to the terms of the current refuse collection contract and any addendum, including, but not limited to, restrictions on trash, garbage and refuse to be disposed; size and weight requirements of containers and bags; and payment of all charges.
(C) Failure of any resident or business to subscribe to the service, to pay all charges set forth in the agreement, or otherwise to comply with the terms of the agreement, shall be deemed a nuisance.
