§ 153.0976 ADMINISTRATIVE EXCEPTIONS.
   (A)   Applicability. To facilitate flexibility in design while maintaining the safety, health and welfare of the public, the City Manager may grant administrative exceptions to the following technical design requirements found in the following sections of this chapter:
      (1)   Storm water management (§§ 153.1035 through 153.1053 of this chapter);
      (2)   Design homeland security and sustainability (§§ 153.0995 through 153.1003 of this chapter);
      (3)   Infrastructure standards (§§ 153.1015 through 153.1023 of this chapter);
      (4)   Street design and transportation (§§ 153.1065 through 153.1078 of this chapter);
      (5)   Utilities (§§ 153.1090 through 153.1095 of this chapter); and
      (6)   Parking and loading standards (§§ 153.1295 through 153.1301 and 153.1315 through 153.1321 of this chapter).
   (B)   Standards for administrative exceptions. No administrative exception shall be granted unless:
      (1)   The Code Enforcement Officer certifies that the proposed exception does not conflict with the goals and policies of the Comprehensive Plan; and
      (2)   The applicant demonstrates, through documentation and/or studies based on generally accepted engineering principles, that the proposed exception would not pose a threat to health and safety.
