9-2-1-3: PRELIMINARY PLAT APPROVAL:
The preliminary plat is a drawing, and when necessary, accompanied by other engineering drawings, on which final review for adherence to design standards and improvement proposals is based.
   A.   Preparation: This plat shall be prepared by a surveyor or engineer subsequent to and in accordance with the agreements reached in the sketch plan conference. It shall be prepared in accordance with all applicable provisions of this Title and other ordinances and shall be submitted in twenty (20) copies.
   B.   Filing: The preliminary plat shall be considered officially filed after it is examined by the Plan Commission and found to be in full compliance with the specifications governing the preparations of plats and plans, and after the required procedural steps have been duly taken.
   C.   Review: The Village Engineer, Village Zoning Officer and the Village Attorney shall check the plat for compliance with the appropriate portions of this Title and other applicable regulations. A written report recommending approval or disapproval and giving the reasons therefor shall be sent to the Plan Commission by each of them within forty five (45) days.
   D.   Accompanying Documents and Developer Report Responsibilities:
      1.   Before a preliminary plat may be considered for approval, it shall be accompanied by the approval in writing of the State for any preliminary plat containing thereon or bordering on any public waters in which the State has any property rights or property interest. It shall be the responsibility of the developer to solicit such approval.
      2.   Before a preliminary plat may be considered for approval, it shall be accompanied by a natural resource opinion from the Lake County Soil and Water Conservation District. It shall be the responsibility of the developer to make such application and pay any required fees to the Lake County Soil and Water Conservation District.
      3.   Where the preliminary plat contains utility easements, the plat shall be accompanied by a written statement bearing signature of an authorized employee of the utility company attesting to the suitability of said easements for the purpose shown before a preliminary plat may be considered for approval.
      4.   U.S. Army Corps of Engineer/Illinois Department of Transportations wetlands report.
      5.   Lake County Department of Transportation report and traffic impact study.
      6.   Documents suggested in subsection 9-2-1-2B are required to be submitted with preliminary plats. (Ord. 90-03, 7-25-90)
   E.   Preliminary Plat Approval and Hearing: The Plan Commission shall review the plat and approve or disapprove the plat, and submit its recommendation giving written reasons therefor, to the Village Board within ninety (90) days. The Village Board shall review and accept or reject the recommendation of the Plan Commission giving written reasons therefor. The Village Board shall conduct a hearing on the question of accepting or rejecting the recommendation of the Plan Commission at its next regular meeting held more than ten (10) days after receiving this report. Within three (3) business days after the recommendation of the Plan Commission has been received by the Village Board, the president of the school board of each elementary and high school district in which a part of the subdivision is located shall be given notice by the Village Clerk by certified mail as required by statute, of the recommendations of the Plan Commission and the date and place at which the Village Board shall conduct a hearing thereon, at which time they may be heard on the issue of approving or disapproving the plat.    F.   Time Allowed to Submit Final Plat: If a final plat is not submitted within one year of date of approval, the preliminary plat shall expire unless approval has been extended, or unless a reservation is shown on the plat for good cause shown.
Time Extension: One, and only one extension, not to exceed six (6) months, may be granted by the Plan Commission.
   G.   Distribution: In addition to furnishing twenty (20) copies of all documents filed, the applicant shall at the time of filing the application for preliminary plat, submit to the Village Clerk, evidence that he has delivered a copy of all documents filed to each of the following persons:
      1.   Heath Officer (being the Lake County Health Department).
      2.   Chief of the Libertyville Fire Protection District.
      3.   Superintendent of Lake County Department of Transportation.
      4.   Superintendent of Lake County Department of Public Works.
      5.   The superintendent of each school district in which part or all of the subdivision is located.
      6.   Such other persons as the Village may hereafter designate. (Ord. 90-03, 7-25-90)
