9-1-7: RESUBDIVISION AND REPLATTING STANDARDS:
The Planning Commission shall, in the performance of its plat approving function, encourage and facilitate the replatting of prematurely and inexpertly subdivided areas which are now in sharp contrast to current standards of acceptability. Rehabilitation of these areas shall be implemented through proper design considerations when adjacent unsubdivided land is proposed for development.
   A.   Whenever application is made for the resubdivision of existing lots or parcels of record which qualifies as a "minor subdivision" as defined in Section 9-1-5 of this Title, and which is for the purpose of adjusting the size or configuration of a nonresidential lot or parcel to create a single lot from part or all of one or more lots to permit a specific principal building to be erected or structurally altered thereon in conformance with the requirements of Section 8-7-1 of this Code, the following provisions shall apply:
      1.   The filing fee for such resubdivision shall be reduced to one hundred dollars ($100.00). All other deposits and fees required by this Code shall be paid, unless previously paid at the time of original subdivision.
      2.   The Plan Commission shall only require a hearing upon the proposed final plat, although the applicant may submit a sketch or preliminary plat for informal review and approval prior to the hearing on the final plat.
      3.   The Village Engineer and Village Attorney shall approve the final plat before it is presented for hearing for the limited purpose of determining that no changes to existing roadway, utility, drainage or other facilities will be required to conform to applicable subdivision standards, or if changes are required, they have been properly designed and performance thereof has been assured.
      4.   Such resubdivision shall not create any remainder lots or parcels which fail to conform to the applicable zoning and subdivision standards. (Ord. 95-07, 2-22-95)
