7-1-11: CONSTRUCTION OF TENNIS COURTS AND RECREATIONAL FACILITIES:
   A.   Purpose: It is the purpose of this section to control the construction and use of tennis courts and other playing courts or recreational facilities requiring hard, paved, graded or special surfaces.
   B.   Applicability Of Regulations: These regulations shall apply to all lands within the corporate limits of the village.
   C.   Building Permit Required: No construction shall commence until an application for a building permit has been applied for and a building permit issued. Such application shall include complete plans and specifications, location sketch, and drainage drawings. Fees for the building permit shall be established from time to time by the board of trustees of the village 1 .
   D.   Hard Surfaces: All tennis courts and other recreational facilities requiring hard, paved, graded or special surfaces shall meet the following requirements:
      1.   Setback shall be the same as those established for accessory buildings for the zone in which they are to be constructed.
      2.   Coverage shall be included in the computation for total lot coverage permitted in that zone.
      3.   Construction on a lot served by a septic system shall be in accordance with the following:
         a.   All such lots shall provide a reserve capacity for a septic system equivalent in square footage to at least the square footage of the existing septic system.
         b.   No portion of the tennis court or recreational facility shall infringe upon the existing septic system or the area reserved for reserve septic system capacity.
      4.   Said construction shall not change natural drainage or increase the flow of water from the lot on which it is to be constructed onto adjacent property. (Ord. 76-06, 3-22-1976)
      5.   A fence not higher than twelve feet (12') may enclose all or part of the facility. The fence must be designed and constructed to prohibit tennis balls or other recreational equipment from traveling onto adjacent properties, and must comply with all other relevant laws, ordinances and regulations.       6.   In the event lighting is provided, lighting must be installed in such a manner so as not to cause glare on adjacent property. (Ord. 76-06, 3-22-1976)
