(A) Violations.
(1) Any person who violates § 91.07(A) and (B) commits a Class B violation.
(2) Any person who violates § 91.07(C) through (G) commits a Class C violation.
(3) Any person who violates § 91.08 commits a Class A violation.
(4) Any person who violates § 91.09 commits a Class C violation.
(B) Penalties and sanctions.
(1) Any person committing a Class A violation of this chapter shall be fined a sum of not less than $100 per instance, plus all costs and attorneys fees for the collection of such fines.
(2) Any person committing a Class B violation of this chapter shall be fined a sum of $50 per instance, plus all costs and attorneys fees for the collection of such fines.
(3) Any person committing a Class C violation of this chapter shall be fined a sum of $20 per instance, plus all costs and attorneys fees for the collection of such fines.
(4) Any person found to be in violation of any provision of this chapter shall, in addition to any fines, be liable for all reasonable attorney fees and costs incurred by the county in the enforcement of this chapter.
(5) For continuous violations, each day constitutes a separate instance.
(C) County Animal Control Fund.
(1) Every fine and penalty thus assessed or collected under this chapter shall be deposited into the County Animal Bite and Neglect Fund.
(2) The Animal Bite and Neglect Fund shall be used by the county for animal control and other purposes consistent with this chapter.
