§ 52.07 HEAVY AND SPECIAL TRASH PICK UP.
   (A)   The city, at its discretion and to the extent it deems feasible in consideration of available equipment, personnel, and disposal facilities, shall provide pick-up and disposal of heavy and special trash for premises within the city, provided that the procedures, terms, and conditions of this section are complied with, as follows.
      (1)   Requests for heavy or special trash pick-up. Heavy or special trash as defined under § 52.01 will be picked up only by special arrangement and upon request submitted to and approved by the City Manager or his or her designee. The request must specify the type and quantity of heavy or special trash for which collection is sought, and should be submitted at least one working day in advance of the proposed time of collection.
      (2)   Time of pick-up. An approximate time for heavy or special pick-up shall be arranged and agreed upon between the requestor and the City Manager or his or her designee when the request is submitted and approved. Ordinarily, pick-up will be provided only during normal working hours of Sanitation Department employees. The requestor shall be responsible for having all items or materials properly placed and available for pick-up at the indicated time, and upon failure to do so shall nevertheless be liable for payment of applicable fees as hereafter provided unless specific notice to cancel the pick-up is given to the City Manager or his or her designee prior to the time that a truck is dispatched to make the pick-up.
      (3)   Placement for pick-up. Items or materials to be collected under this section shall be placed at the curb or in any other location as directed by the City Manager or his or her designee. Heavy or special trash items or materials shall not be placed for pick-up along with regular collection service refuse unless specifically so authorized by the Superintendent.
      (4)   Service charges.
         (a)   For collection and disposal of heavy or special trash, the requestor must pay to the city the following initial service charges:
            1.   For junk stoves, refrigerators, freezers, water heaters, washers, dryers, or equivalent heavy appliances - all refrigerators and freezers shall be free of freon - $10 per item;
            2.   TV with 39 inch or larger screens - $10 each;
            3.   TV with screens smaller than 39 inches - $5 each;
            4.   Mattresses or box springs - $15 each;
            5.   Sofas, chairs, and household goods - $10 each;
            6.   For brush, shrubbery, tree limbs, dirt, gravel, and similar materials - $25 per truckload or fraction thereof;
            7.   For other items or materials requiring special pick-up under this section - $85 per truckload or fraction thereof subject also to any additional charges as may be applicable under division (A)(5) below.
            8.   Charges owing under this division (A)(4) or under division (A)(5) below shall be paid prior to collection unless otherwise authorized by the City Manager or his or her designee, and shall be deposited in the General Fund.
            (b)   The initial service charges contained within § 52.07 of this code are subject to change. The City Manager may, from time-to-time, issue changes to the initial service charges by posting a notice of such change at the utility building. The change in service charges shall reflect the costs of the Sanitation Department.
      (5)   Hazardous materials or special handling. The City Manager or his or her designee may, in his or her full discretion, refuse to provide pick-up service for heavy or special trash which includes any hazardous materials which would require special equipment or personnel in excess of the normal crew complement of a collection truck, which must be made other than during normal working hours, or which would otherwise require any special handling or disposal methods. Alternatively, the City Manager or his or her designee may accept the items or materials, but as a condition shall require the requestor to pay any additional costs so incurred by the city over and above the charges applicable under division (A)(4) above.
      (6)   Regular heavy or special trash service; contracts. In the case of any business, industry, construction contractor, institution or other person who would require heavy or special trash pick-up on a more or less regular or long-term basis, the City Council may enter into a contract with the person to have the service rendered by the city. The contract may stipulate requirements, procedures, charges, or other special provisions which differ from or are supplementary to those otherwise set forth in and applicable under this section, and any such stipulations of the contract shall prevail over any conflicting provisions of this section.
   (B)   The implementation and continuation of the heavy and special trash pick-up program as provided in this section shall be at such time as determined and directed by the City Council, and the service may be suspended or discontinued by order of the City Council whenever it considers it in the best interests of the city to do so.
