§ 151.999 PENALTY.
   (A)   Ohio Basic Building Code.
      (1)   Whoever violates or fails to comply with any of the provisions of §§ 151.001 through 151.007, including any provision of the Ohio Basic Building Code adopted in § 151.001, is guilty of a misdemeanor of the first degree and shall be fined not more than $1,000 or imprisoned not more than six months, or both, for each offense. Unless otherwise provided, a separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
      (2)   The application of the penalty provided in division (A)(1) of this section shall not be deemed to prevent the enforced removal of prohibited conditions, or the application of any other equitable remedy, including abatement of the nuisance referred to in § 151.005(F).

   (B)   International One- and Two-Family Dwelling Code.
      (1)   Whoever violates or fails to comply with any of the provisions of the International One- and Two-Family Dwelling Code, as adopted in § 151.020, is guilty of a misdemeanor of the third degree and shall be fined not more than $500 or imprisoned not more than 60 days, or both, for each offense. Unless otherwise provided, a separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
      (2)   The application of the penalty provided in division (B)(1) of this section shall not be deemed to prevent the enforced removal of prohibited conditions, or the application of any other equitable remedy.

   (C)   Ohio Plumbing Code.
      (1)   Whoever violates or fails to comply with any of the provisions of the Ohio Plumbing Code, as adopted in § 151.035, is guilty of a misdemeanor of the third degree and shall be fined not more than $500 or imprisoned not more than 60 days, or both, for each offense. Unless otherwise provided, a separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
 
      (2)   The application of the penalty provided in division (C)(1) of this section shall not be deemed to prevent the enforced removal of prohibited conditions, or the application of any other equitable remedy.

   (D)   National Electrical Code.
      (1)   Whoever violates or fails to comply with any of the provisions of the National Electrical Code, as adopted in § 151.050, is guilty of a misdemeanor of the third degree and shall be fined not more than $500 or imprisoned not more than 60 days, or both, for each offense. Unless otherwise provided, a separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
      (2)   The application of the penalty provided in division (D)(1) of this section shall not be deemed to prevent the enforced removal of prohibited conditions, or the application of any other equitable remedy.

   (E)   Exterior Property Maintenance Code.
      (1)   Whoever violates §§ 151.065 through 151.076 shall be fined not more than:
         (a)   One hundred dollars for the first offense;
         (b)   Two hundred dollars for the second offense; and
         (c)   Four hundred dollars for the third offense within a one-year period. Subsequent offenses shall be referred directly to the Director of Law for legal action.
      (2)   The application of the penalty provided in division (E)(1) of this section shall not be held to prevent the enforced removal of prohibited conditions.
      (3)   No person shall violate any provision or fail to comply with any of the requirements of this Exterior Property Maintenance Code or fail to comply with any order made thereunder.
      (4)   Whoever violates §§ 151.065 through 151.076 shall be subject to the following penalties.
         (a)   Whosoever violates any section is guilty of a minor misdemeanor for each offense. Each day an offense occurs constitutes a separate offense.
         (b)   If within one year of the date of the offense, the offender has been convicted or pleads guilty to another violation under §§ 151.065 through 151.076, the offender is guilty of a misdemeanor of the third degree.
      (5)   The application of the penalty provided in division (D)(4) of this section shall be in addition to and not in lieu of all civil remedies available for the enforcement of §§ 151.065 through 151.076 in the abatement of the nuisance and/or the enforced removal of prohibited conditions.
