7-1-25: RATES:
   A.   The City after the effective date hereof shall reserve the right to amend residential rate structures for garbage service. (Ord. 775, 9-20-2004; amd. Ord. 925, 10-1-2018)
   B.   By the adoption of section 7-1-13 of this chapter, the City has made mandatory the use of ninety five (95) gallon residential mechanical carts within the City for all solid waste except for "yard waste" as otherwise defined in this chapter. Therefore, it shall be the rate that each residence shall pay the amount established in the master fee schedule. Residential mechanical containers, also known as carts, in excess of one per residence shall pay an additional fee as established in the master fee schedule. If more than four (4) carts are used the residential user will be required to subscribe to a commercial container of two (2) yards in capacity or bigger. (Ord. 775, 9-20-2004; amd.    C.   Additionally, the residential mechanical cart may be used for commercial businesses which produce limited amounts of solid waste. For commercial establishments the fee for carts will be as established in the master fee schedule, up to a maximum of four (4) carts at which time that commercial user will be required to subscribe to a commercial container of two (2) yards in capacity or larger.
   D.   The City hereby reserves the right to ratify and approve the commercial rate structure as the same shall be agreed upon between the contractor and any commercial user in the future. The commercial rate structure adopted in ordinance 612 or the commercial rate for the use of residential mechanical containers/carts shall be as described in this section. Those rates shall remain in place until they are amended. New commercial rate structures may not be adopted unless the contract shall provide for such amended rate structures to the City Clerk as shall be agreed upon between the contractor and such commercial users. The provisions of subsection 7-1-3D of this chapter relating to the City's power to regulate maximum rates shall remain unimpaired by the adoption of this section.
   E.   The City Clerk shall maintain in her office, open to public inspection, copies of all rate schedules and make the same available to members of the public upon inquiry. (Ord. 775, 9-20-2004; amd. Ord. 925, 10-1-2018)
