(a) The practice of vending as defined in Section 725.01
shall constitute a nuisance and is prohibited except as provided in this chapter.
(b) No vending shall take place, without first having procured from the Director of Public Safety of the City a written permit to do so, except as provided in this chapter.
(c) Applications for permits shall be obtained from the City's administration office, completed, and filed with the Director of Public Safety, with at least the following information, no less than two (2) business days before the permit is to be issued:
(1) The name of the applicant, to include the name of any company for which the applicant is purporting to sell goods or services and the name of the individual doing so;
(2) The applicant's social security number and federal identification number of the company the applicant represents;
(3) The name and address of the person by whom the applicant is employed, or for whom he or she is vending, and the length of the applicant's service with such employer or person, and a cell phone number and email address where the individual can be contacted;
(4) If the applicant is an individual, all places of residence of the applicant and all employment during the preceding year;
(5) The nature and character of the goods to be sold or services to be furnished by the applicant, or the purpose for which funds are being solicited, and a web address where goods or services being sold may be viewed;
(6) The names of all municipalities in which the applicant has conducted peddling or solicitation activities within the past twelve (12) months;
(7) If the applicant is a recognized charitable not-for-profit organization, proof of tax exempt status may be requested
(8) Disclosure of any prior or current criminal record;
(9) The period of time for which the permit is requested;
(10) Signatures of the vendor or solicitor and/or official of the organization he or she represents.
(d) Applicants who are individuals shall show government-issued photo identification upon request.
(e) If, after investigation, the Director of Public Safety determines that the information furnished on the application is complete and accurate, and the applicant and/or enterprise meets the requirements listed in Section 725.03
, the Director of Public Safety shall issue a permit to the applicant.
(f) No person shall directly or indirectly make or perpetrate any misstatement, deception of fraud in connection with any solicitation or vending for any purpose in the City or in any permit application.
(g) No person, having entered into an agreement to conduct any vending on behalf of any person or organization, shall fail to remit or pay to the party entitled thereto the proceeds of such solicitation or vending in accordance with the terms of the agreement.
(h) Solicitation for grass cutting, tree removal, leaf raking, and snow removal where payment for aforesaid services does not exceed the sum of seventy-five dollars ($75.00) shall not be deemed a violation of this section. (Ord. 2020-12. Passed 9-8-20.)
