725.01 DEFINITIONS.
   As used in this chapter the following words are defined as hereafter set forth:
   (a)   "Vendor", "peddler", "hawker", "itinerant retailer," and "solicitor", collectively referred to in this chapter as "vendor", means a person who offers goods, wares, merchandise, chattels, vegetables, fruits, foodstuff of any description, any substance for human consumption or any commodity or other article, and/or services for sale and/or for the purpose of disposing of and/or peddling or hawking the same by going in and upon private residences and the property upon which they are situated, not having been requested or invited by the occupant thereof, and/or by going upon the public streets or other public property, or upon property of another. A sale or purchase is not necessary for this definition to be applicable. The person engaged in such activities shall not be relieved from the provisions of this chapter by reason of association temporarily with any local merchant, dealer, trader, or auctioneer, or by conducting such temporary or transient business in connection with or as a part of the business of or in the name of any local merchant, dealer, trader, or auctioneer.A Canvassers and charitable organizations conducting fundraising through the sale of goods and/or services are not included in the foregoing definition.
   (b)   "Vending" is the activity described in Section 725.01 (a).
   (c)   "Canvasser" means any person who goes upon the premises of any private residence in the City, not having been requested or invited by the occupant thereof, who seeks to disseminate any verbal or written message, including ideas, thoughts or messages regarding any cause, issue, or religion; any person circulating petitions for signatures; or any political candidate, by means of traveling from place-to-place without acting as a vendor, and whose actions do not violate any local, state or federal law. Canvasser includes a person who requests a voluntary donation to a political or charitable organization as part of the verbal or written message. Nothing in this definition exempts a canvasser from the requirements of any other chapter of the Codified Ordinances.
   (d)   "Canvassing" is the activity described in Section 725.01 (c).
   (e)   "Charitable organization" means any benevolent, philanthropic, patriotic, religious, educational, civic, fraternal, social research, or other eleemosynary organization, as evidenced by a non-profit incorporation with the Ohio Secretary of State or a tax-exempt determination by the Internal Revenue Service.
