(a) The City shall conduct an independent record check of all applicants, and shall retain the authority to exempt an applicant from the record check based on information known to the City, such as prior history, locally established connections, community ties, scholastic endeavors, non-profit history, or similar information. Upon investigation and determination by the Director of Public Safety or his/her designee, a permit shall be issued, subject to verification that:
(1) All of the statements made in the application are true;
(2) The applicant or organization proposes to engage in a lawful commercial or professional enterprise;
(3) Neither the applicant nor organization or enterprise the applicant represents proposes are engaged in activity that constitutes a clear and present danger to the residents of the City;
(4) Neither the applicant nor the represented organization has engaged in any fraudulent transaction or enterprise;
(5) The business of the peddler or solicitor will not be a fraud upon the public;
(6) Neither the applicant nor organization represented has been convicted of any felony and/or crime involving moral turpitude (e.g., theft, passing bad checks, misuse of a credit card, unauthorized use of property or vehicle, identity theft, etc.);
(7) The applicant and/or organization has not been determined by any law enforcement agency, governmental enforcement agency, or private organization that monitors or reports on charitable activity or consumer products or safety to provide goods or services or to engage in business that are injurious to the public;
(8) Neither the applicant nor the organization has engaged in a disruptive, threatening, or discourteous manner or behavior;
(b) The permit fee for permits granted pursuant to this chapter shall not exceed fifty dollars ($50.00) and shall be in effect for a period not to exceed ninety (90) days from the date of issuance. The applicant will be provided with a copy of the permit, and the original shall be maintained at the Clerk's office at City Hall and be available for public inspection.
(c) The permit fee shall be waived with respect to organizations whose missions are exclusively for charitable, eleemosynary, educational or religious purposes and whose efforts are in furtherance of the City's schools and related extracurricular programs, the City's library or the county library system, social-services agencies or tax-exempt entities that render services within the City, and any other non-profit or tax-exempt program that the Director of Public Safety shall determine meets the spirit of the waiver.
(d) The Director of Public Safety may revoke at any time, any permit granted pursuant to this chapter for violation of this chapter or if any of the requirements contained in Section 725.03
are no longer met. Notice of revocation, which shall state the reason therefore, shall be delivered to the applicant in person, or mailed by first class mail to his last known address and shall be effective upon mailing. (Ord. 2020-12. Passed 9-8-20.)
