Notwithstanding any of the provisions of this chapter, the city council may as authorized by State Statutes make or authorize the Purchasing Agent or others to make emergency procurements of supplies, services, or construction when there exists a threat from infectious or contagious diseases, destructive windstorms, floods, snow, war, or an exigency or pressing necessity or unforeseen need calling for immediate action or remedy to prevent a serious loss of, or serious injury or damage to life, health, welfare, safety, endangering property, or cause disruption of public utility services; provided, that such emergency procurements shall be made with such competition as is practicable under the circumstances. A written determination of the basis for the emergency and for the selection of the particular contractor shall be included in the contract file. A copy of the contract and department justification of the emergency shall be provided to the Purchasing Agent within three (3) business days after the contract approval. A copy of the justification shall be kept with the contract in the contract file.
