1024.01   CULVERTS.
   (a)   Any person desiring to construct or replace a driveway from a public street or highway to adjacent private property, and across a street or highway drainage ditch, shall make an application to the Village Administrator, on a form provided by the Village, for a driveway culvert permit, giving the location of the proposed culvert, the name of the abutting property owner and any other pertinent information required by the Village Administrator or the Village Engineer.
   (b)   New driveway culverts shall be constructed of galvanized corrugated metal pipe, reinforced concrete pipe or other equivalent materials approved by the Village Engineer. The culvert type, size and length shall be determined by the Village Engineer, and in no case shall it be less than twelve inches in diameter and twenty-two feet in length. Each driveway culvert shall be bedded in granular material, a minimum depth of four inches, approved by the Village Engineer, and backfilled to a height of six inches above the top of the pipe with granular material approved by the Village Engineer. Variances from these requirements may be granted by the Village Engineer in specific cases, at his or her discretion.

1024.99   PENALTY.
   Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
