509.09 OPERATING POWER EQUIPMENT; HOURS.
   (a)   Non-Commercial Work. No person shall disturb the peace and quiet of the Village by the outdoor use of internal combustion engine powered equipment, including, but not limited to, equipment used for tree cutting, lawn mowing, landscaping, grading or demolition, erection, alteration or repair of buildings or structures within the Village after 9:00 p.m. of each day and before 7:00 a.m. of each day, except Sundays and legal holidays, when such equipment may not be operated before 9:00 a.m. Snow blowers and other snow removal equipment are specifically excluded during periods of snowfall. Motor vehicles are also specifically excluded.
   (b)   Commercial Contractor Doing Work in Any Use District. Any person who is a contractor as defined in Section 711.01 of the Codified Ordinances of the Village of Glenwillow, and doing work for any amount of pay in any use district in the Village shall only be permitted to operate outdoor power equipment as defined in subsection (a) above during the following hours:
      Monday thru Friday - 7:00 a.m. to 7:00 p.m.
      Saturday - 8:00 a.m. to 4:00 p.m.
      Sundays and Legal Holidays - None
   (c)   Commercial - Extended Hours Under Certain Circumstances. An owner of land in any industrial use district in the Village or a commercial contractor performing construction on such property may apply for a temporary permit to operate outdoor power equipment during times other than those specified in subsection (a) above by satisfying all of the following:
      (1)   Upon application and demonstration to the satisfaction of the Mayor that inclement weather, or work stoppage or equipment breakdown or some other similar unfortunate circumstance has caused a construction schedule emergency; and
      (2)   Upon presentation of a schedule of proposed equipment to be operated, and the proposed hours and days of operation; and
      (3)   Upon preparation and presentation of a study which demonstrates to the Mayor’s satisfaction that the noise impact of such proposed operation on all residences located within 1,000 yards of the location of the proposed operation will not be detrimental; and
      (4)   Upon payment of a two thousand dollar ($2,000) application fee (to cover Village monitoring and administration costs); then
      (5)   The Mayor may at his sole discretion grant a temporary permit subject to the following conditions:
         A.   Only the equipment listed on the permit may be operated;
         B.   Such temporary use is subject to any condition the Mayor may deem proper for the protection of the public peace, health, safety and welfare;
         C.   Such equipment may only be operated at the times allowed in the permit but no later than midnight of each day;
         D.   Such permits may be issued for periods of time up to one week at a time but the Mayor may renew such weekly permits assuming no changes and no additional application fee as he may deem proper for up to eight weeks;
         E.   The permit is revocable at any time by the Mayor.
   (d)   Whatever person, firm or corporation violates this section shall be guilty of a minor misdemeanor.
