1113.02 GENERAL PROVISIONS FOR APPLICATION FILING.
   The requirements of this section shall apply to all applications and review procedures set forth in this Planning and Zoning Code, unless otherwise stated.
   (a)   Authority To File Applications. The person having legal authority to take action in accordance with the approval sought shall file an application for review in accordance with this Code. The person having legal authority shall be the record owner or the duly authorized agent of the record owner who may be required to provide proof of such authority at the time of application.
   (b)   Application Filing Requirements. Applications required under this Code shall be submitted in a form and in such numbers as established by the Chief Building Official and shall be accompanied by:
      (1)   An application form provided by the Village, completed and signed by the applicant.
      (2)   Evidence of HOA Approval. Whenever an applicant submits an application governed by this Code pertaining to a single-family dwelling that is part of a Homeowners' Association, the application shall include the written approval of the Homeowners' Association (HOA) attesting that the proposed application complies with the HOA's covenants and restrictions.
      (3)   All required plans, drawing, and other documents that are required by this Code based on the type of application submitted.
      (4)   Payment of Fee(s). Applications shall be accompanied by the fee required in the Glenwillow Village Council.
   (c)   Application Filing Deadline. For applications requiring review by the Planning Commission and/or the Architectural Review Board, the applicant shall file an application with the Chief Building Official at least thirty (30) days before the date of the Village's public meeting at which such application is to be considered.
   (d)   Complete Application Determination.  
      (1)   Within fourteen (14) days after receiving an application, the Chief Building Official, along with any administrative assistance required, shall review the submitted application to determine compliance with the applicable submission requirements and shall provide a written determination to the applicant.
         A.   Incomplete Applications.
            1.   If the application is determined to be incomplete, the Chief Building Official shall notify the applicant of necessary changes or additional information needed. No further processing of an incomplete application shall occur until the deficiencies are corrected.
            2.   The applicant shall then submit this additional or revised information to the Chief Building Official within sixty (60) days of the determination pursuant to paragraph 1, unless the Chief Building Official agrees in writing to a longer period.
            3.   If the applicant fails to submit this additional or revised information within the timeframe allotted, the incomplete application shall not be processed, the applicant's original fee shall be forfeited and the incomplete application shall be deemed withdrawn.
            4.   Further reconsideration of an application after expiration of the sixty (60) day period shall be considered a new application, subject to the submission requirements and payment of the fee.
         B.   Complete Applications. Once an application is determined to be complete, the Chief Building Official shall process the application according to the procedures set forth in this Code.
      (2)   An application is complete for purposes of this Section when it meets the completeness requirements of, or is deemed complete under, this Section, even though additional information may be required or modifications in the development or use may occur subsequently. The completeness determination does not preclude the Chief Building Official, Planning Commission or Architectural Board of Review or Village Council from requesting additional information or studies either at the time of the notice of completeness or subsequently if new information is required or substantial changes in the proposed development occur.
      (3)   If any false or misleading information is submitted or supplied by an applicant on an application, that application shall be deemed incomplete.
   (e)   Review Meeting Date. For applications requiring review by the Planning Commission and/or the Architectural Review Board, a complete application will be placed on the agenda of the appropriate board for the next regularly scheduled meeting occurring not less than fourteen (14) days from the date the application is determined complete.
   (f)   Refund of Fees. Application or review fees are not refundable except where the Chief Building Official determines that an application was accepted in error, or the fee paid exceeds the amount due, in which case the amount of the overpayment will be refunded to the applicant.
   (g)   Submission Schedule. The Chief Building Official is authorized to and shall establish the submission and review schedule for applications. The Chief Building Official may amend and update these requirements as determined necessary.
   (h)   Required Times for Action and Inaction. Whenever the provisions of this Code require that reviewers or decision-makers take action on an application within a specified period and such action is not taken within that time-frame, such inaction shall be deemed a denial of the application unless the applicant agrees to an extension of the review period.
   (i)   Records. A record of all applications submitted and certificates issued shall be kept on file in the Building Department.
