137.01 SNOW REMOVAL ASSISTANCE.
   (a)   Snow removal assistance will be provided for certain qualified residents of single family dwellings in the Village who meet the following qualifications:
      (1)   Are sixty-five years of age or older.
      (2)   If under age sixty-five but are physically disabled to the extent that driveway snow removal would be difficult or dangerous to the resident’s health as evidenced by a doctor’s certificate and having no income other than retirement income or disability income.
      (3)   Be an owner or lessee of a single family residence in the Village and be currently living on the premises at the time snow is to be removed such that it is necessary for the resident to have access to the street.
      (4)   Apply to the Village by completing and signing the application forms and consents and releases as are prepared and approved by the Law Director and provided by the Village. A qualifying resident need only apply once so long as the representations contained in the application do not change.
      (5)   Have no other able-bodied person, capable of removing the snow from the driveway, residing therein.
   (b)   The Village shall, upon determining that a resident meets the criteria outlined in subsection (a) hereof, place the name and address on a list and the entire list shall be delivered to the Street Commissioner at the earliest possible time after completion.
   (c)   The Street Commissioner and his personnel shall provide the following snow removal assistance to such residents:
      (1)   Upon determination by the Street Commissioner that there has been at least a four inch accumulation of snow or if drifting conditions, as determined by the Street Commissioner, warrant new plowing of driveways; and only after all ordinary and necessary public highway and street snow removal and salting has been accomplished as determined by the Street Commissioner; and only after a determination by the Street Commissioner that the Village snow plowing equipment and personnel are available for duty; the Street Commissioner may proceed to provide snow plowing assistance to the aforesaid private residences.
      (2)   The Street Commissioner shall, when able as aforesaid, make two passes with a snow plow mounted on a motor vehicle thereby making the driveway passable by motor vehicles. There shall be no other plowing and no shoveling of walks or other areas by Village personnel.
      (3)   The snow removal assistance shall not be provided on any schedule or during any specific times as it shall be solely within the administrative discretion of the Street Commissioner as to the time of plowing or order of plowing.
      (4)   The Street Commissioner shall have the right to determine the best and safest method for plowing any given residence driveway and such determination shall be final.
      (5)   At the sole discretion of the Village, snow plows may be rented and personnel may be hired to plow driveways in this program.
      (6)   Any qualifying resident shall be expected to cooperate fully with the Street Commissioner, or his personnel, in providing the snow removal assistance and any abuses as determined by the Street Commissioner will result in termination of such service to such resident.
   (d)   Council expressly reserves the right to terminate this snow removal assistance program without notice at any time it deems best.
