139.10 SICK LEAVE.
   (a)    Full-time employees shall be entitled to sick leave, accumulated at four and six-tenths (4.6) hours upon completion of each eighty (80) hours worked. Hours worked shall include vacation and holiday hours, but does not include overtime hours, or sick leave, or unpaid personal leave.
 
   (b)   A maximum of one hundred and twenty (120) hours of sick leave may be accumulated per year.
 
   (c)   Employees on paid sick leave will be paid at their regular rate of pay.
 
   (d)   Unused sick leave shall be cumulative.
 
   (e)   Sick leave may be used upon approval of the Mayor and/or Department Head and due to personal illness, injury, exposure to a contagious disease, illness or injury to the employee's spouse or children, or examination of the employee or a member of the employee's immediate family by an appropriate licensed practitioner. At the discretion of the Mayor and/or Department Head, medical documentation may be required from a doctor to justify the sick leave for employees returning to work after three (3) consecutive days absent. The Village may also request its own doctor of choice (at the Village's expense) to certify fitness for return to work.
 
   (f)   Employees who transfer between Village departments or are rehired by the Village within one year shall be credited with their prior unused accumulated sick time. This shall not apply to a person who has retired and is then rehired.
 
   (g)   An employee, at the time of retirement from active service with the Village, or upon the death of an employee while in active service, shall be paid up to one-fourth (1/4), or twenty-five percent (25%), of the value of earned but unused sick time credit. Retirement is defined as disability or retirement from active Village service under any state or municipal retirement system in Ohio.
