(a) No person shall play any radio, music player, such as a car stereo system, “boom box” or CD player, television, audio system, musical instrument (or instruments), or any other type of sound amplification or dissemination system or equipment in a manner or at a volume to create a nuisance and which disturbs the peace, quiet and repose of other persons.
(b) No person shall play any radio, music player, such as a car stereo system, “boom box” or CD player, television, audio system, musical instrument (or instruments), or any other type of sound amplification or dissemination system or equipment in a manner or at a volume which is plainly audible at a distance of one hundred (100) feet or more from the building, structure, vehicle, or equipment which is the source of the noise.
(c) Any person, firm or corporation who violates subsections (a) or (b) above shall be guilty of a minor misdemeanor on a first offense, a misdemeanor of the fourth degree for the second offense and a misdemeanor of the third degree for every subsequent offense.
