5-3-9: CONTAINER REQUIREMENTS:
   A.   Containers Required: Every person in possession of any premises in the village shall provide, and at all times maintain in good order and repair, a sufficient number of waste containers for a weekly accumulation of normal waste.
   B.   Specifications And Conditions Generally: All waste containers shall meet the requirements set out under the definition of same in section 5-3-1 of this chapter, and no other type of container shall be acceptable. Filthy, leaking or defective receptacles shall be cleaned, repaired or replaced by the person in possession of the premises served, and at his expense, as directed by the director of public works or his designee. All containers shall be kept clean and disinfected with an effective antiseptic solution as often as is necessary to maintain them in a sanitary condition. Evidence of neglect of the requirements of this subsection shall be determined by the director of public works or his designee.
   C.   Institutional, Commercial And Industrial Containers And Racks:
      1.   Waste Containers: Institutional, commercial and industrial waste containers not mounted on wheels shall be stored on durable racks, placed on an easily cleanable impervious surface. The racks shall raise the waste containers at least twelve inches (12") off the storage surface. Containers mounted on wheels shall be specifically designed for use with collection vehicles. The wheels of the containers must elevate the base of the container a distance of at least six inches (6") off the storage surface. Storage floors must have an impervious, easily cleanable surface.
      2.   Waste Enclosures:
         a.   All outside trash bins and dumpsters must be enclosed by a waste enclosure. All waste enclosures must be at least six feet (6') in height and conceal trash from public view. Additionally, all enclosures, with the exception of those on multi-family residential properties, must have four (4) sides and have a gate that latches closed. Multi-family residential enclosures may be enclosed on three (3) sides.
         b.   Business owners shall be required to apply for an appropriate building permit for a dumpster enclosure. All fence enclosures shall be inspected by the village community development department.
      3.   Waste To Be Covered: All outside trash bins and dumpsters must be covered at all times. Any trash that is too large to fit inside the trash bin or dumpster must be stacked inside the trash enclosure.
   D.   Use Of Containers Required: Every person in possession of any premises in the village shall, except as otherwise provided in this chapter, cause to be deposited in waste containers all waste produced in or on such premises as soon as practicable after the same is produced.
   E.   Placement, Removal And Storage:
      1.   Placement For Collection: All waste containers and receptacles shall be placed in the parkway area in front of the premises at or near the curb as follows:
         a.   November 1 through March 31: No earlier than two o'clock (2:00) P.M. on the day preceding the day when such waste is to be collected.
         b.   April 1 through October 31: No earlier than two o'clock (2:00) P.M. on the day preceding the day when such waste is to be collected.
      2.   Removal After Collection: All waste containers and receptacles shall be removed from the parkway areas not later than seven o'clock (7:00) A.M. the day following collection.
      3.   Storage Between Collections: At all times between collections, waste containers and receptacles shall be kept within each individual lot's lines, either at the rear or side yard premises.
      4.   Placement On Public Ways Prohibited: No waste container or receptacle shall be placed in any street, parkway, alley or sidewalk of the village.
   F.   Scavenging Through, Removal From Containers Prohibited; Exceptions:
      1.   No person shall scavenge, search through, or remove from a container or other receptacle located on any public street, alley, parkway, right of way, or other public property any solid waste or recyclable materials which have been placed therein for collection.
      2.   Subsection F1 of this section shall not apply to village authorized and licensed solid waste collection activities, authorized members of any law enforcement agency or to any members of the same household and their contractors or employees who place solid waste or recyclable materials in a container or other receptacle on a public street, alley, parkway, right of way or other public property in the village.
