5-3-1: DEFINITIONS:
For the purpose of this chapter the following words and phrases shall have the meanings respectively ascribed to them in this section:
CUSTOMER: Any single-family unit or other premises receiving service from a waste disposal contractor or firm.
DIRECTOR OF PUBLIC WORKS: The director of public works of the village or his designee, or such other officer as may be designated from time to time by the village president.
DUMPING: Placing or disposing of any garbage, rubbish, trash, refuse, waste or litter which is not properly contained in appropriate trash bins or dumpsters.
GARBAGE: Any rejected or waste household food, offal, swill or carrion and every accumulation of animal, fruit or vegetable matter that attends the preparation, use, cooking and dealing in or storage of meats, fish, fowl, fruits or vegetables, and any other matter of any nature which is subject to decay, putrefaction and the generation of noxious or offensive gases or odor, or which, during or after decay, may serve as a breeding or feeding material for rodents, flies or other germ carrying insects or animals.
PREMISES: Any house, residence, building, flat, apartment dwelling place or place of abode, commercial or industrial establishment, hotel, church, school, hospital, club building or meeting hall.
WASTE: Includes, but shall not be limited to, any garbage, trash, refuse, debris, rubbish, mud, grass clippings or other lawn or garden waste, newspaper, magazines, glass, metal, plastic or paper containers or other packaging construction material, motor vehicle parts, furniture, oil, appliances, household furnishings, household fixtures, trees, tree branches, tree roots, tree trunks, brush, shrubs, plant stalks, plant and tree leaves, refuse, ashes, tin cans, dead animals or parts thereof, any nauseous or offensive matter of any kind, or any object likely to injure any person or create a traffic hazard.
WASTE CONTAINER: A container with a close fitting cover of galvanized iron or noncorrodible metal, or other material which is rodentproof and flyproof, nonabsorbent, durable and leakproof, of the type commonly sold as a garbage can, of a suitable gauge and construction to ensure durability, with suitable handles on the can and lid, and of a capacity of not less than ten (10) gallons and not more than thirty two (32) gallons. However, containers may exceed thirty two (32) gallons but not more than ninety (90) gallons if the container is supplied by the village's franchised waste hauler.
WASTE DISPOSAL CONTRACTOR: Any person with whom the village has contracted for the removal of waste from within the village. (1978 Code § 9-2-1-1; amd. Ord. 96-38, 5-2-1996; Ord. 99-16, 3-8-1999; 2011 Code; Ord. 2014-15, 3-20-2014)
