5-1-1: DEFINITIONS:
For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them in this section:
FOOD: Beverages, other than alcoholic liquor, as well as food.
FOOD DEALER: Every person engaged in the sale of food or beverages, other than intoxicating liquor, intended for human consumption.
RESTAURANT: Any place where food or drink, other than alcoholic liquor, is prepared or served to the public for consumption on the premises or is sold in a fully prepared form. (1978 Code § 9-1-1)
5-1-2: SALE OF UNWHOLESOME, ADULTERATED FOODS PROHIBITED:
   A.   Unwholesome Food: No person shall offer for sale, or keep for the purpose of selling or offering for sale, any food of any kind intended for human consumption which is spoiled or tainted or is unwholesome and unfit for human consumption for any reason.
   B.   Adulterated Food: It shall be unlawful to sell or offer for sale, or keep for such purpose, any food or drink intended for human consumption which has been adulterated by any material harmful in any way, or which does not comply with state law governing the same. (1978 Code § 9-1-2)
5-1-3: EXAMINATION AND CONDEMNATION OF FOOD OR DRINK:
Samples of food, drink and other substances may be taken and examined by the director of community development or other officer designated by the village board of trustees as often as may be necessary for the detection of unwholesomeness or adulteration. The director of community development or other officer designated by the village board may condemn and forbid the sale of, or cause to be removed or destroyed, any food or drink which is unwholesome or adulterated. 5-1-4: PERSONS HANDLING FOOD:
   A.   All persons engaged in handling food or coming in contact with food intended for sale for human consumption shall keep themselves clean, both as to person and clothing.
   B.   It shall be unlawful for any person who is afflicted with or is a carrier of any infectious or contagious disease to handle or be engaged in the care or preparation of any food. It shall be unlawful to permit any such person to be employed in or about any premises where food is stored, prepared or sold, or to deliver such food. (1978 Code § 9-1-4)
