1330.06  ADVERTISING DEVICES PERMITTED FOR ON-PREMISES USE.
   (a)   The following advertising devices permitted for on-premises use are:
      (1)   Freestanding signs
      (2)   Wall signs
      (3)   Marquee signs
      (4)   Awning or canopy signs
      (5)   Portable signs
      (6)   Roof signs
      (7)   Window
      (8)   Banner
      (9)   Festoon
      (10)   Flag
      (11)   Real Estate
      (12)   Projecting
   (b)   The following regulations shall apply for Freestanding signs.
      (1)   Number of signs permitted.
         A.   Single occupant commercial, business/industrial establishments.
            1.   Not more than one ground mounted or pole mounted sign, meeting the size requirements of this section, shall be permitted on any one parcel of land containing one single building with one single occupant.
            2.   For purposes of this chapter, those single occupant commercial, business/industrial establishments who have at the effective date of this chapter more than one ground mounted or pole mounted sign, for the expressed purpose of on-premises advertising targeted toward traffic on Interstate 80, shall be exempted from the one sign per parcel of land regulation, but not to exceed more than two.
         B.   Multiple occupant, single-building commercial, business/industrial establishments.
            1.    Not more than one ground mounted or pole mounted sign, meeting the size requirements of this section, shall be permitted on any one parcel of land containing one single building.
         C.   Parcels containing multiple buildings, with one or more occupants per building.
            1.    Not more than one ground mounted or pole mounted sign, meeting the size requirements of this section, shall be permitted on any one parcel of land containing one or more buildings with one or more occupants.
      (2)   Size of signs permitted.
         A.   Ground or pole mounted signs shall contain not more than two faces,  and each face shall be no larger than 100 square feet in area.
         B.    Ground or pole mounted signs shall not exceed an overall height of 50 feet from grade.
         C.    Any existing ground or pole mounted signs which exceed a height of 50 feet from grade, that are used for the expressed purpose of on premises advertising targeted toward traffic on Interstate 80, shall be exempted from the height restriction.
         D.    Any business, commercial/industrial establishment wishing to erect a new ground or pole mounted sign that would exceed a height of 50 feet from grade, must make application for a conditional use permit to the Zoning Inspector of such construction, and application must be approved by the Zoning Inspector and Zoning Board of Appeals.
      (3   Location of signs.
         A.    Ground or pole mounted signs should be set back a minimum of 10 feet from the right of way line. If a minimum of 10 feet is not available, then said sign should be set back half the distance from the right of way line and the business, commercial/industrial establishment.
         B.    Excepted as noted otherwise herein, no sign shall be placed as to obstruct any window, door, stairway or any other ingress or egress to a building.
         C.    No sign shall be erected so as to obstruct traffic sight lines or traffic control devices.
      (4)   Illumination of signs.
         A.    Freestanding signs may be illuminated, but subject to regulations as outlined in Section 1330.05.
   (c)   The following regulations shall apply for Wall signs.
      (1)   Number of signs permitted.
         A.   One principal wall sign shall be permitted on the front of the business establishment which it represents. Secondary wall signs are permitted, but subject to regulations as outlined in Section 1330.06(c)(3).
         B.    Signs painted upon a wall or walls are prohibited.
      (2)   Size of signs permitted.
         A.    Wall signs shall not exceed sixty square feet in sign area per sign.
         B.    Wall signs shall not protrude past any wall or above the roof line.
         C.    Wall signs shall be framed and securely attached to the wall.
      (3)   Location of signs.
         A.    Wall signs may not exceed one sign per wall.
         B.    Wall signs shall be limited to the walls which can be viewed from the public streets or highways.
         C.    No sign shall be placed as to obstruct any window, door, stairway, or any other ingress or egress to a building.
         D.    No sign shall be erected as to obstruct traffic sight lines or traffic control devices.
      (4)   Illumination of signs.
         A.    Wall signs may be illuminated, but subject to regulations as outlined in Section 1330.05.
   (d)   The following regulations shall apply for Marquee Signs.
      (1)   Signs located on a marquee shall be affixed to the face or top thereof.
      (2)   Not to be greater than four feet in vertical measurement above the marquee.
      (3)   Not extend vertically below the marquee.
      (4)   Not extend horizontally more than eighteen inches beyond the marquee limit.
      (5)   Shall contain no more than two faces.
   (e)   The following regulations shall apply for Awning/Canopy signs.
      (1)   Signs located on an awning or canopy shall be non illuminated and indicate only the name. and/or address of the occupant:.
      (2)   Not extend vertically or horizontally beyond the limits of the awning or canopy.
      (3)   Be fixed flat to the surface thereof.
   (f)   The following regulations shall apply for Portable signs.
      (1)   No portable sign shall extend nearer than fifteen feet from the edge of the pavement of any street or public way. If not feasible, no portable sign shall extend closer than one half the distance from the edge of the street or public way to the front of the closest building or structure.
      (2)   Portable "trailer mounted" signs shall not exceed a height of seven feet  from grade.
      (3)   Framed or wire mounted portable signs shall not exceed a height of four feet from grade.
      (4)   Portable signs may be illuminated but shall not contain any flashing lights or moving parts.
      (5)   Any business wishing to erect a new portable "trailer mounted" sign for the purpose of on premises advertising, must make application for a Conditional Use permit to the Zoning Inspector for such placement, and  application must be approved by the Zoning inspector and Zoning Board of Appeals.
   (g)   The following regulations shall apply for Roof signs.
      (1)   No roof sign structure shall be erected higher than twenty five feet above the roof of the building to which attached at the point of mounting, and a clearance of at least six feet shall be provided between the base of such signs and the roof level.
      (2)   Roof signs shall not extend beyond or overhang any exterior wall of the building upon which they are secured.
      (3)   Roof signs are permitted to be erected upon one story building roofs, provided not more than one roof sign structure shall be permitted upon a building.
      (4)   Roof signs shall not exceed sixty square feet in sign area.
      (5)   Roof signs may be illuminated, but subject to regulations outlined in Section 1330.05.
   (h)   The following regulations shall apply for Window signs.
      (1)   A window sign may not occupy more than fifty percent (50%) of the area of the window on which it is displayed.
      (2)   Digital window signs are permitted, but must be mounted on the inside of the window.
   (i)   The following regulations shall apply for Banner type signs.
      (1)   Banner signs shall be securely affixed to the building or other permanent structure.
   (j)   The following regulations shall apply for Festoon type devices.
      (1)   Festoon type devices must be securely affixed to the building or other permanent structure.
      (2)   Festoon devices must be replaced/repaired if they become tattered or torn.
   (k)   The following regulations shall apply for Flag type devices.
      (1)   Flags used to advertise a business or product/service shall be limited to two (2) flags per business.
      (2)   Flags must be replaced/repaired if they become tattered or torn.
   (l)   The following regulations shall apply for Real Estate signs.
      (1)   In Business, Commercial/Industrial areas real estate signs may be used to advertise the sale, lease, or rental of the premises on which it is displayed.
      (2)   One sign per each 150 feet of street frontage.
      (3)   Maximum sign area shall not exceed sixteen square feet.
      (4)   Signs may be placed on walls which face public streets or highways.
      (5)   Signs may not be illuminated.
      (6)   Maximum sign height from ground shall be six feet to top of the post or sign, whichever is higher from the ground level.
      (7)   A real estate sign shall be allowed to remain in the ground for ten working days after closing date or completion or transaction.
      (8)   Signs shall not have more than two faces.
   (m)   The following regulations shall apply for Projecting signs.
      (1)   The bottom of a projecting sign may not be less than ten feet above grade.
      (2)   Shall be erected in such a manner that it forms an angle of ninety degrees the wall to which it is attached or with the property line where the detached sign is erected.
      (3)   Projecting signs erected at the corners of buildings or properties may be set so as to bisect the angle between the intersecting walls or property line.
      (4)   A projecting sign extending not more than three (3) feet from the face of the building shall not be restricted as to the angle it makes with the face of the building wall.
