(A) Any person who violates any provision of this chapter for which no penalty is provided shall be subject to the terms of § 10.99.
(B) Whoever violates any provision of § 53.002 or fails to correct the discharge beyond the time limit provided in the notice provided in § 53.002(B), shall be fined not more than $100 for each violation. Each day’s violation shall constitute a separate offense. Any owner or occupant violating these sections shall become liable to the town for any expense, loss or damage occasioned the town by reason of the violation.
(C) (1) Any person found to be violating any provision of §§ 53.015 through 53.017, 53.030 through 53.039, 53.051 through 53.062, 53.075, and 53.076 shall be served by the town with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in the notice, permanently cease all violations.
(2) Any person who shall continue any violation (other than a violation of § 53.051) beyond the time limit provided for in division (C)(1) above shall be fined in an amount not less than $25 and not exceeding $500 for each violation. Each day in which any violation shall continue shall be deemed a separate offense.
(4) (a) Any person violating or suspected of violating § 53.051 shall be subjected to a penalty of $50 per month (or fraction thereof in which the violation occurs).
(c) A person consenting to this inspection and found in violation shall be given 90 days to comply with § 53.051 without being subject to penalty.
