848.03   TEMPORARY BUSINESS PERMIT; FEE AND DURATION.
   (a)   Permit Required.  Every person, whether principal or agent, who proposes to conduct or engage in a temporary business for the sale of goods, foods, services, amusement rides, entertainment, games, or merchandise on public or private property during special events, including the Grape Jamboree, Geneva Winterfest, Geneva Ghoulfest and other special events approved by City Administrators or City Council, shall obtain a permit from the City Manager or his/her designee, before opening same and before offering for sale such sale of goods, foods, services, amusement rides, entertainment, games, merchandise, or property.
   (b)   Temporary Business Permit Fee.  The fee for a temporary business permit shall be equal to the permit fees required in Section 848.02 (b).
   (c)   City approved farmer's markets shall only be required to obtain one license to cover all vendors doing business as part of the farmer's market.
   (d)   A temporary business permit fee shall not be required for juveniles who set up stands or tables on private property to sell goods or services for organized fundraising purposes.
   (e)   Violations.
      (1)   Any person who violates any provisions of this section shall be deemed guilty of a minor misdemeanor on the first day of the offense, and shall be subject to a mandatory minimum fine of eighty dollars ($80.00). Each day upon which any such violation occurs or continues shall constitute a misdemeanor of the fourth degree, and shall be subject to a mandatory minimum fine of one hundred sixty dollars ($160.00) and up to thirty days in jail.
      (2)   Upon notification of a violation of any provision of this section, the temporary business vendor must cease and desist its operations, and dissemble and remove the temporary business operation immediately. Failure to dissemble and remove the temporary business operation may result in additional criminal penalties, including, but not limited to criminal trespass, littering and/or other zoning code violations.
