848.02  SALES FROM PUBLIC WAYS AND PLACES.
   (a)   Application of Section. Except as otherwise provided in Sections 1252.03(b) and 1252.04(b) of the Zoning Code, sales from public ways and places shall be regulated as provided in this section.

   (b)   License Required; Fee. No person shall sell or offer for sale in, on or from any street, sidewalk or alley in the City, or from any motor vehicle or other type of vehicle, whether motor propelled or not, located upon any street, sidewalk or alley in the City, any goods, merchandise, foodstuffs or other article or thing, until he or she has obtained a license therefor from the City Manager. The fee for such license shall be eighty dollars ($80.00) for commercial enterprises and fifty dollars ($50.00) for nonprofit organizations.

   (c)   Hours; Sound Reproducing Devices. No person shall sell or offer for sale in, on or from any street, sidewalk or alley in the City, or from any motor vehicle or other type of vehicle, whether motor propelled or not, located upon any street, sidewalk or alley in the City, foodstuffs or other articles or things of any kind at any time other than between the hours of 10:00 a.m. and 9:00 p.m.
   No such person shall produce or allow to be produced, by means of any sound reproducing device, unnecessarily loud or continual sounds in such a manner as to disturb the good order and quiet of a neighborhood in connection with such sales or offers to sell.
   (d)   Exceptions. This section does not apply to:
      (1)   The sale of produce from any stand or mobile unit constructed or existing off the traveled portion of any street, sidewalk or alley in the City and for which a permit has been issued pursuant to the ordinances of the City; or
      (2)   The sale of produce or articles in or on amusement grounds, parks, halls and other duly licensed public places.
