(a) Administrative Authority. Subdivisions which meet all of the criteria for classification as a minor subdivision, as set forth in Section 1240.06(b)(16), may be approved by the City Manager without referral to the Planning Commission and City Council, provided that all requirements of these Subdivision Regulations are met and that the plat has received a favorable review from the Development Engineer.
Where there are unusual conditions or matters of special concern associated with a proposed minor subdivision, as identified by either the City Manager or the Development Engineer, said plat shall be forwarded to the Planning Commission for review.
(b) Submission. The applicant shall prepare and submit an application for approval which shall include:
(1) A completed minor subdivision application form.
(2) Three copies of legal descriptions and survey plats for the property prepared by a registered surveyor.
(3) A filing fee as set forth in Section 1242.05.
(4) If lots are to be served by individual sewer systems, a letter of approval for each site signed by the Health Commissioner.
(c) Action by City Manager. Upon receipt of a complete application for a minor subdivision, as set forth in subsection (b) hereof, the City Manager shall declare the same to be officially filed and shall refer it to the Development Engineer for review and comment. Said Engineer shall provide comments and recommendations to the Manager within five working days after receipt thereof. The City Manager shall review the application and the comments of the Development Engineer and shall act upon the application within ten working days from the date of official filing. The Manager may approve, conditionally approve or disapprove the subdivision.
(d) Appeal of Administrative Decision. Any person aggrieved by a decision of the City Manager under this section shall have the right to appeal said decision to the Planning Commission by filing a written notice of appeal within ten days from the date of the decision.
(e) Limit of Approval. Approvals of minor subdivisions granted by the City Manager shall expire after sixty days, unless the plat and/or conveyances are recorded in the office of the County Recorder prior to said date.
(f) Final Approval and Recording. The City Manager shall indicate final approval of a minor subdivision by placing an approval stamp and signature on the deed and/or plat. Upon receipt of recording fees from the subdivider, as set forth in Section 1242.05, the Manager shall cause said deed and/or plat to be placed on record with the County Recorder and County Auditor.
