No permit may be issued for an uninhabited structure or accessory structure within one hundred (100) feet of an oil and gas well or a tank battery. No permit may be issued for a habitable structure or accessory structure within three hundred thirty (330) feet of an oil and gas well or a tank battery. Prior to issuing any permit for a structure or accessory structure, the Building Official shall check with the Ohio Department of Natural Resources, Division of Mineral Resources, to determine whether a permit has been issued for an oil and gas well or tank battery or has been applied for on the property on which the structure is to be located.
