1373.03 PERMIT APPLICATION REVIEW.
   (a)   Applicants are encouraged to appear before the Planning Commission for a pre-review of proposed wireless communication antenna and tower sites, which pre-review may be conducted by the Planning Commission upon the applicant's submittal of a site plan with the general location, type of structure and height being reviewed, and surrounding uses.
 
   (b)   With the formal permit application to the Planning Commission, the applicant shall file a complete set of plans, specifications and other submittal requirements required by Section 1373.11, as well as the filing fees required by Section 1373.13.  
 
   (c)   The Planning Commission shall review the application in accordance with the criteria established in this chapter. The applicant shall appear at all Planning Commission meetings to answer any questions which may arise from Commission members and to supply information to the members of the Planning Commission.
 
   (d)   Prior to taking any action on the application, the Planning Commission will cause notice of the pending application to be sent by certified mail to all abutting property owners and property owners within 1,000 feet of the parcel on which the antenna and/or tower is to be located. The Building Official may also provide notice by regular first-class mail to any other property owner in the Village whom he or she feels will be substantially impacted by the siting of this tower. The failure of the Building Official to give notice as required in this section shall not affect the validity of the Planning Commission's action. The foregoing notice requirement may be waived by the Planning Commission for construction of a new antenna on an existing structure, which application does not require the construction of a new tower or associated facilities.
 
   (e)   After conducting its meeting, the Planning Commission may act upon the application. Any decision to deny a request to place, construct or modify a wireless communication antenna and/or tower shall be in writing and shall be supported by substantial evidence contained in a written record of the proceedings of the Planning Commission.
 
   (f)   Approval by the Planning Commission of the granting of a permit shall become effective only following review and approval by the Village Council. A certified copy of a resolution of the Planning Commission granting such permit shall be filed forthwith by the Secretary of the Planning Commission with the Clerk of Council. Within the thirty-day period next succeeding such filing, Council, by a majority vote, must approve, disapprove or approve with modification the Planning Commission's action in granting the permit. Any decision to deny a permit to place, construct or modify a wireless communication antenna and/or tower shall be in writing and supported by substantial evidence contained in a written record of the proceedings of Council.
 
   (g)   After approval by Council, any plans for equipment buildings and accessory structures shall be submitted to the Architectural Board of Review for review and approval under Chapter 1313 of the Building Code.
 
   (h)   After approval by the Architectural Board of Review, the Building Official is authorized to issue a permit in accordance with all prior approvals.
