(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(2) Each day such violation is permitted to continue shall be deemed to constitute a separate offense.
(3) The violation and penalty as herein described in this division (B) shall not be subject to any other fine or penalty within this chapter.
(C) A person violating the provisions of §§ 93.20 through 93.25 shall be guilty of a misdemeanor and, upon conviction, shall be fined not less than $25 nor more than $300, to which may be added imprisonment of five days. Each day’s violation shall be regarded as committed each day of which such person shall continue or permit any violation to exist after notification thereof by any or all enforcement officers.
(D) A violation of § 93.40 constitutes an infraction which may be punishable by a fine of not less than $10 or more than $50 for the first occurrence and not less than $100 or more than $500 for a second occurrence within five years of the first occurrence of violation.
(E) Any person that violates § 93.41 shall be deemed to have committed an ordinance violation and, upon conviction, shall be fined not more than $25 for each violation. This fine is in addition to any cost of collection procedures set forth by Indiana Code. All fireworks found in the possession or control of anyone in violation of § 93.41 will be confiscated and disposed of as thereafter directed by the Court.
