§ 93.40 CONSUMER FIREWORKS.
   (A)   Except as herein provided, the use or discharge of consumer fireworks within the city shall be prohibited, and it shall be a violation of this section to use, ignite, or discharge any type of consumer fireworks, as defined by I.C. 22-11-14, within the corporate limits of the city; provided however, the prohibition shall not apply:
      (1)   Between the hours of 5:00 p.m. and two hours after sunset on June 29, June 30, July 1, July 2, July 3, July 5, July 7, July 8, and July 9;
      (2)   Between the hours of 10:00 a.m. and 12:00 a.m. on July 4; and
      (3)   Between the hours of 10:00 a.m. on December 31 and 1:00 a.m. on January 1.
   (B)   Provided further, the use or discharge of consumer fireworks on the times and on the dates herein specified may take place only:
      (1)   At a specified discharge location as designated by the City Fire Chief;
      (2)   Upon property of the person using or discharging the consumer fireworks; or
      (3)   On the property of one who gives permission to use and discharge consumer fireworks.
