It shall hereafter be the policy of the Gardner Village Council of the Village of Gardner to require the payment of the school facilities impact fees created herein as a condition of the annexation of residential territory to the Village of Gardner. Therefore, unless otherwise authorized or directed by the Gardner Village Council, the annexation of residential territory after the effective date of this chapter shall be effected pursuant to an annexation agreement requiring the payment of school facilities impact fees in substantial accordance with the provisions set forth in Appendix A below, to compensate the school districts from the development, as a condition of the issuance of a residential building permit. This chapter shall have no application to properties that are annexed to the Village of Gardner for uses other than residential.
