§ 15.15.070  CARGO CONTAINERS.
   (A)   Cargo containers, as defined in § 15.15.100, shall be allowed as a conditional permitted use in an M-1 (Manufacturing) Zone only, subject to the following minimum conditions.
      (1)   Only one cargo container will be allowed for each five acres, with a maximum of ten cargo containers at any manufacturing site.
      (2)   Cargo containers located within the village should not exceed a length of 30 feet.
      (3)   Cargo containers shall be located to minimize the visual impact to adjacent properties, parks, trails and rights-of-way through the use of adequate screening. The screening may be a combination of a solid fencing, landscaping, or the placement of the cargo containers behind, between or within buildings.
      (4)   If located adjacent to a building, all cargo containers must be painted to match the building’s color.
      (5)   All cargo containers must have working doors and locks.
      (6)   Cargo containers may not occupy any required off-street parking spaces.
      (7)   Cargo containers shall meet all setback requirements for the zoning district where they are placed and allowed.
      (8)   Outdoor cargo containers shall not be refrigerated.
      (9)   Outdoor cargo containers shall not be stacked.
      (10)   Cargo containers shall be placed on a level hard surface, such as gravel, blacktop, a concrete or other hard surface approved by the Village Board.
   (B)   The Planning and Zoning Board may recommend and the Village Board may impose such additional conditions as may be deemed reasonable and/or appropriate.
   (C)   No cargo containers shall be allowed within any residential or commercial zoning district within the corporate limits of the Village of Gardner.
   (D)   License and bonded contractors may use cargo containers in any zone for temporary storage of any equipment and/or materials at a construction site during construction that is authorized by a village building permit. The cargo containers shall not be allowed to remain at any such construction site subsequent to the issuance of an occupancy permit or the completion of construction, whichever occurs first.
   (E)   Any cargo containers which are existing as nonconforming structures at the time of this section shall be removed within one year from the effective date of this section.
   (F)   Any person, firm or corporation in violation of the provisions of this section shall be subject to the penalties set forth in § 15.15.999 of the Zoning Code, as amended.
