(A) The Mayor, after consideration of the application and upon the appearance of the applicant or the applicant’s duly authorized agent or representative, shall approve the application if the applicant has conformed to the requirements of this chapter, pursuant to his or her determination that the issuance of a certificate of registration hereunder is not adverse to the public health and welfare of the community. The certificate of registration shall have an effective date endorsed upon its face, effective not less than ten days after its issuance. At the Mayor’s discretion, the application may be submitted to the entire Village Council for consideration and approval as herein above described. In the event, the applicant shall appear at the next regular or special meeting of the Council for its determination. In the event the certificate is granted, it shall conform to the provisions of this paragraph above. In the event that the Village Council shall deny the application and refuse to issue a certificate of registration hereunder, the Mayor shall endorse the denial on the application, and notice thereof shall be sent to the applicant.
(B) Any certificate of registration issued hereunder shall be revoked by the Mayor if the holder of the certificate of registration is convicted of a violation of any of the provisions of this chapter, has made a false and material statement in the application as submitted, has been the subject of complaints by residents of the Village of Gardner for failure to leave their premises upon request, or otherwise becomes disqualified for the issuance of a certificate of registration under the terms of this chapter. Immediately upon any revocation, notice thereof shall be given by the Village Clerk to the holder of the certificate of registration in person or by United States Mail to the applicant’s address as shown on the application. Thereafter, the certificate of registration shall become immediately null and void. The certificate, unless revoked as herein above provided, shall be valid for a period of one year from the date of issuance. In the event that any certificate is revoked under the terms of this division, the solicitor’s validation card, referred to herein, shall also become void and all soliciting thereunder shall cease forthwith upon verbal notification by the Mayor or his or her agent. A solicitor may contest the revocation by demanding a hearing thereon at the next regular or special meeting of the Council. The demand shall be made to the Clerk on a form provided by him or her. Pending the hearing, the daily validation card shall be void.
(C) (1) In addition to the certificate of registration referred to herein above, each solicitor shall obtain from the Village Clerk a solicitor’s validation card for each day or days upon which he or she intends to solicit within the village limits. The card may be requested at the time of initial application for certificate of registration, or at any time during the one year in which the certificate of registration shall be valid.
(2) Each request for a solicitor’s validation card shall be accompanied by prepayment of the fees referred to herein in § 11.15.035.
