(a) The provisions of this article shall not apply to recognized charitable, religious or civic organizations conducting authorized rummage or bake sales or as otherwise exempted by state law.
(b) This article shall not apply to sales pursuant to the order of any court of competent jurisdiction in the state, nor shall it conflict with any state or federal statute, nor shall it apply to any person owning or operating a branch store or stores, provided such person or the principal of such person has been engaged in the same kind of business in this state for a period of more than 120 days prior to the date of opening such branch store.
(c) The City Manager or his designee hereby is authorized to refrain from collecting a temporary store license fee from any person upon the presentation of satisfactory evidence indicating that the location of a store shall be permanent and not temporary in nature.
