SECTION 23. PROCEDURE FOR REMOVAL OF APPOINTIVE OFFICERS.
   Upon the presentation to the City Commission of a petition containing the signatures of electors of the City of Gallipolis, Ohio, equaling in number not less than twenty percent of the number of electors who voted at the last regular or municipal election, requesting the removal of the City Manager, or any other officer of the City appointed by the City Commission, said Commission shall immediately set a time for a public hearing not later than ten days from the date of the filing of said petition. Said petition shall also contain the charges against said officer whose removal is sought, and shall, so far as applicable, be circulated and signed in accordance with the provisions of Section 75 governing the circulation of initiative petitions, and shall have written or printed thereon the names and addresses of at least five electors, who shall be officially regarded as filing the petition, and who shall constitute a committee for the prosecution of the charges against said officer. Not later than five days after the conclusion of said public hearing, said City Commission shall proceed to vote upon a resolution to remove said officer by yea and nay vote of every member of the City Commission. Any member refusing to vote shall be recorded as voting nay, and the vote upon said resolution shall be entered upon the journal, and a copy of such record shall be inserted by the Clerk of the City Commission in a newspaper of general circulation in the City of Gallipolis, Ohio, in accordance with Section 15, but this section shall not be construed as in any manner abridging the powers of the City Commission on its own initiative to remove officers appointed by said City Commission as provided in other sections of this charter.
