§ 95.16 REQUIREMENTS.
   (A)   The person, corporation or firm making application for a permit for the construction site shall also be responsible for complying with all provisions of this subchapter as provided for herein.
   (B)   Any construction site located within the city limits shall have portable chemical toilets located on the premises. This provision shall not apply when available sanitation facilities as defined in § 95.15 are present. It shall be the determination of the Zoning Administrator as to whether available sanitation facilities are acceptable and as to the location and number of portable chemical toilets required for a construction site.
   (C)   No portable chemical toilet shall be located within 20 feet of another commercial or residential structure, nor within ten feet of any property lines. Location of the portable chemical toilet, if required, shall be provided to the Zoning Administrator before any building permit is issued. Placement of the portable chemical toilet on-site shall be made prior to commencement of work at the construction site.
   (D)   All portable chemical toilets shall be maintained in a sanitary condition, and serviced regularly. Should any portable chemical toilet be found to be in an unsanitary condition as determined by the Zoning Administrator, a written notice shall be directed to the person, corporation or firm who received a permit for the construction site for immediate compliance.
   (E)   Construction sites involving more than one lot may utilize a centralized location for placement of portable chemical toilets. The number and location of portable chemical toilets shall be determined by the Zoning Administrator. In the case of construction sites involving a large number of lots or in the case of large developments or construction projects, the Zoning Administrator shall require the primary developer or contractor to provide information as to the location and number of portable chemical toilets prior to receiving approval from the city to proceed on any such project.
