7-2-2: PROHIBITED ACTS:
The following activities shall be prohibited in all parks:
   A.   Motor Vehicles In Parks:
      1.   No cars, four-wheelers, three-wheelers, motorcycles or motor vehicles of any kind shall be driven or parked upon the sidewalks or within the boundaries of any park in the city, except in those areas which have been surfaced for vehicular traffic or which have been designated by the city or the Fruitland school district as an area for motorized transportation. This rule shall not prohibit the use of ADA compliant wheelchairs that are motorized and other similar accessibility enhancing devices by disabled individuals or park maintenance vehicles.
      2.   It is unlawful to park or display "for sale vehicles" within the boundaries of a park or a park parking lot. The parks department may have vehicles which violate this section towed immediately, without notice, at owner's expense. (Ord. 564, 8-26-2013)
   B.   Alcoholic Beverages; Tobacco: Except as provided in subsection L of this section, no person shall consume any liquor, spirits, malt liquor, beer, wine or any alcoholic beverage of any kind, or have in his possession any opened containers or receptacles containing any liquor, spirits, malt liquor, beer, wine or any alcoholic beverage while on any park grounds. In addition, no person shall use any tobacco products on any park grounds owned by the Fruitland school district. (Ord. 564, 8-26-2013; amd. 2014 Code)
   C.   Sale Of Food Or Goods: Except as permitted by the Fruitland school district on school district property, no person shall sell any goods, food or food products of any kind in any park, including adjacent rights of way such as sidewalks or parking lots, without first obtaining a license as a solicitor's license as required in title 3, chapter 6 of this code. Any person who wants to operate a concession for any extended period of time, including, but not limited to, athletic tournaments, in any park, must first enter into a written agreement for such duration as the owner of the park may require and the contract must first be approved by the property owner's governing body. In addition, the person shall obtain such licenses and permits as may be required by this code.
   D.   Camping: Overnight camping is prohibited in parks and on other property unless an application has been filed with the city council and a permit has been issued therefor. Camping permits for all events planned at Mesa Park that could entail overnight stays in self-contained recreational vehicles must be applied for by April 30 of each calendar year. For property owned by the Fruitland school district, an application shall be first submitted to the district.
   E.   Recreational Activities In All Parks:
      1.   Participating in any games involving dangerous objects, such as stones, arrows, or javelins is prohibited. Golfing or driving balls shall be prohibited. The use of firearms and/or fireworks shall be and is hereby prohibited in parks.
      2.   Bicycle riding is prohibited in the interior area of softball and/or baseball complexes within parks within the city, except in the event the park area is owned or controlled by the Fruitland school district, bicycle riding is prohibited on any track facility.
      3.   Skateboarding is prohibited in the interior areas of softball or baseball complexes within parks.
   F.   Glass Containers Prohibited: It is prohibited for any person to throw, carry or have in their possession any glass beverage container on park grounds. The interior of athletic complexes is included in this prohibition. On property owned or controlled by the Fruitland school district, glass containers can be brought onto park property.
   G.   Advertising Or Signage In Parks:
      1.   No person shall paste, glue, tack or otherwise post any signs, plaques, advertisements or inscriptions whatsoever in any park, including adjacent rights of way (sidewalks, parking lots, etc.). Plaques, tablets or signs, of a size, design and location approved by the public works supervisor or by the PCRD director or a designated representative, or by the athletic director of the Fruitland school district recognizing or acknowledging donations or contributions to any park or to facilities therein may be exempt.
      2.   Individual teams may place team sponsor banners on their designated dugout fence only for the duration of the game. Sponsor banners are required to have the team name and will be allowed to list sponsors' names or logos on the banner.
   H.   Destruction Of Park Property:
      1.   No person shall mark, deface, disfigure, injure, tamper with, or displace or remove any building, bridges, tables, benches, athletic equipment, school equipment, school district property, fixtures, fireplaces, railings, playground equipment, paving or paving material, water lines or other utilities or parts or appurtenances whatsoever, either real or personal, or have in his possession any of the foregoing things or objects, or any part thereof.
      2.   No person shall despoil, litter, deface, or create an unsanitary condition in a restroom or washroom. No person over the age of six (6) years shall use the park restrooms and washrooms designated for the opposite sex. Both sex and unisex bathrooms shall be excluded from this provision.
      3.   No person shall construct or erect any building or structure of whatever kind, whether permanent or temporary in character, or run or string any utility line onto, upon or across any park, or lands without first obtaining written permission from the city.
      4.   No person shall damage, cut, carve, transplant, or remove any tree or plant, or injure the bark, or pick the flowers or seeds, of any tree, fruit or plant. Nor shall any person attach any rope, wire or other contrivance to any tree or plant. No person shall dig in or otherwise disturb grass areas or in any other way injure or impair the natural beauty or usefulness of any area, unless they have first received approval from the public works supervisor, PCRD director or a designated representative.
   I.   Metal Detecting/Worm Gathering: Except on property owned by the Fruitland school district, it is prohibited for any person to use, place or attempt to place, an electric probe or any similar device, for the purpose of detecting metal or collecting worms in any park. It shall be unlawful for any person to use, place or attempt to place, an electric probe or any similar device, for the purpose of detecting metal or collecting worms or any other property belonging to the city or PCRD.
   J.   Obscene Language; Use Of Amplification Devices: While in a park, no person shall use obscene, abusive or threatening language; use or threaten any act of violence; use a radio, loudspeaker, CD player, tape player, or any other amplification device which can be heard at a distance of more than fifty feet (50') from the source of the amplified sound, without first having obtained a permit issued by the city clerk or a designee thereof; engage in riotous or disorderly conduct; remove or damage any structure, any item of park equipment, any plant or natural feature; ride a bicycle, skateboard or other wheeled implement, except on paved paths, or in such a manner as threatens other park users or interferes with their peaceful enjoyment of the park.
   K.   Fire: No person shall start, ignite, maintain or assist in starting, igniting or maintaining a fire, except in a grill or fireplace which is attended at all times. All fires which are properly maintained shall be extinguished upon leaving the park.
   L.   Consumption Of Alcohol: No person shall consume any alcoholic beverage, except at a place specifically permitted by the city and properly licensed for the sale of alcoholic beverages by the state.
   M.   Interference With Others: No person shall engage in any conduct, which interferes with another person's reasonable use and quiet enjoyment of any park.
   N.   Exiting Park: No person shall refuse to leave a park when directed to do so by a police officer or a member of the public works department when that person has engaged in any activity prohibited by this chapter. (Ord. 564, 8-26-2013)
