Except in those instances where a higher or lower speed is specified by ordinance, it shall be prima facie lawful for the driver of a vehicle to drive the same at a speed not exceeding the following, but in any case when such speed would be unsafe, it shall not be lawful:
A. Unposted Streets: Unless otherwise posted, the speed limit on non-U.S. routes within the city limits shall be twenty five (25) miles per hour.
B. School Zones: Unless otherwise posted, the maximum speed limit in any school zone shall be twenty five (25) miles per hour.
C. Newly Constructed Roads: The posted speed limit for any newly constructed, local, public road under the city jurisdiction shall be established by engineering analysis performed by the city engineer. The posted speed limits recommended in the city engineer's analysis shall become effective when approved by resolution of the city council.
D. Citizen Request For Modification: A citizen may file a written citizen request for modification of any posted speed limit. After receiving the request, the city council may authorize the city transportation engineer to perform an engineering analysis of the road subject to the request, provided the road is a local, public road within the city jurisdiction. Any change to the existing posted speed limit recommended in the engineer's analysis shall become effective when approved by resolution of the city council.
E. Records Maintained: The city clerk shall maintain a written record of all resolutions approving speed limit changes. (1984 Code § 10-1-5-13)
