242.53 FIRE DEPARTMENT CAPITAL FUND.
   (a)   There is hereby created a Fire Department Capital Fund for the purpose of creating an annual threshold amount of funding to be spent only for capital projects relating to the City's Fire Department and matching funds for Fire Department grants. In relation thereto, any funds remitted to the City pursuant to Sections 242.46, 242.54, 242.55 and 242.57 shall initially be deposited into the Fire Department Capital Fund. Subject to the provisions of subsection (c) below, in each fiscal year an amount equal to fifty-four percent of the total amount remitted to the City in the prior fiscal year and placed in the Fire Department Fund may be transferred and deposited into the General Corporate Fund of the City at the discretion of the City Council. The remaining forty-six percent shall remain in the Fire Department Fund. For the purposes of this section, "remitted to the City" shall mean those funds remitted to the City pursuant to Sections 242.46, 242.54, 242.55 and 242.57, exclusive of any collection or administrative fees or expenses.
   (b)   The Fire Department Capital Fund shall be kept and accounted for separately from other funds and used solely for the purposes as set out in this chapter.
   (c)   Notwithstanding anything to the contrary in subsection (a) above, during Fiscal Years 2018-2019 i.e. ending April 30, 2019, a sum equal to 60% of the income generated from ambulance fees during those fiscal years shall be transferred to the General Corporate Fund of the City.
