3-1-1: COMPULSORY USE OF SYSTEM; EXCEPTIONS:
Every owner and occupant of premises within the prescribed limits of the City must use the refuse collection and disposal system herein provided and shall deposit or cause to be deposited in accordance with the regulations all rubbish and garbage, which is accumulated on such premises; provided, that in areas of the City where the collection of garbage and refuse on the schedule hereinafter set forth, would be impracticable, the City Council may issue a special permit altering the time and extent of collection. 3-1-2: DEFINITIONS:
For the purpose of this Chapter, terms used herein are defined as follows:
COLLECTOR: The person holding a license or contract with the City or employed by the City and thereby authorized and designated by the City to collect, handle, transport and dispose of refuse and wastes.
GARBAGE: Includes all putrescible waste, except sewage and body waste, including waste accumulated of animal, food or vegetable matter, and including waste that attends the preparation, use, cooking, dealing in or storing of meat, fish, fowl, fruit and vegetable, and shall include all of such wastes or accumulations of vegetable matter of residences, restaurants, hotels and places where food is prepared for human consumption.
The term "garbage" shall not include recognized industrial by-products.
INSPECTOR: The authorized employee or employees of the City or some individual designated by the City Council as having the duty of enforcement of this Chapter.
OWNER OR OCCUPANT: May be used interchangeably, and shall mean every person in possession, occupancy, charge or control of any dwelling, flat, rooming house or any eating place, shop, place of business, manufacturing or business establishment where garbage or other refuse is created or accumulated.
PERSON: Any person, firm, partnership, association, institute or corporation and a plural as well as a singular.
REFUSE: Solid wastes, including garbage and rubbish.
RUBBISH: Refuse other than garbage (tin cans, bottles, ashes, paper, pasteboard, cardboard, or wooden boxes, leaves, weeds and cuttings from lawns and gardens and other waste materials produced in normal course of doing business or every day living).
The term "rubbish" shall not include recognized industrial by-products.
WASTE: Unwanted solids, liquids or gaseous materials. (Ord. 10, 12-12-1972)
