§ 92.99  PENALTY.
   (A)   Any person violating any provisions of this chapter for which no other penalty is provided shall be subject to the provisions of § 10.99.
   (B)   Violation of § 92.01 shall be a misdemeanor and shall be punished by fine not exceeding $300, or by incarceration in the county jail for a period not to exceed six months, or by both such fine and incarceration.
   (C)   Any person found guilty of violating § 92.02 shall be deemed guilty of a misdemeanor as provided for by Idaho Code § 40-2311.
   (D)   Violation of §§ 92.15 to 92.18 or any part hereof shall be a misdemeanor punishable by imprisonment in the county jail for up to six months, or a $300 fine, or by both such fine and imprisonment.
   (E)   Violation of §§ 92.30 to 92.33, or the failure of the owner or tenant to remove such traffic hazard as provided for herein, shall constitute a misdemeanor, punishable by the imposition of a fine in a sum not to exceed $300 or by being incarcerated in the county jail for term not to exceed, six months, or by both such fine and imprisonment, and every day said owner shall fail to remove said obstruction shall be a separate and distinct offense.
   (F)   (1)   Violation of any of the provisions of §§ 92.45 to 92.48 shall constitute a misdemeanor, punishable by the imposition of a fine in a sum not to exceed $300 or by being incarcerated in the county jail for a term not to exceed six months, or by both such fine and imprisonment. Each day such violation continues shall be considered a separate offense. Any landowner, tenant, or any other person who commits, participates in, assists in, or maintains such violation shall be considered a separate offender.
      (2)   Nothing herein contained shall prevent the county from taking civil action to enjoin any violation of §§ 92.45 to 92.48, or from taking such other lawful action as is necessary to restrain or prevent any violation hereof.
