§ 94.01  REQUIREMENTS.
   The following requirements shall apply to all parks, facilities or improvements owned, maintained, operated or situated on property owned by the city for use by skateboarders and inline skaters:
   (A)   The city recommends that any person using the skateboard park, which is located on property owned by the city, wear elbow pads, knee pads, wrist pads and a helmet that meets the standard of either the American Society for Testing and Materials (ASTM) or the United States Consumer Product Safety Commission (CPSC) or standards established by these entities subsequent to the adoption of this section.
   (B)   Any child or children 12 years of age or under who are using the skateboard park shall be supervised by an adult.
   (C)   Use of bicycles in the skateboard park is prohibited.
   (D)   Any person using the skateboard park must wear shoes at all times while in the skateboard park.
   (E)   It shall be a violation of this section for any person to create graffiti in or upon the skateboard park improvements or to engage in tagging or the use of accelerants or wax.
   (F)   It shall be a violation of this section for any person in the skateboard park to use profanity or to engage in horseplay, roughhousing, violence or any potential dangerous activity.
   (G)   Alcoholic beverages, tobacco products, firearms or weapons of any kind are expressly forbidden in the skateboard park on city-owned property.
   (H)   No skating shall be permitted on surfaces containing water, snow or ice. Further, it shall be a violation of this section for any person to cause salt or sand to be applied to the skateboard park facility or to use any means whatsoever for removal of snow or ice from the facility.
   (I)   No person shall use, enter, or be on a skateboard park outside of the hours of operation posted in the skateboard park.
   (J)   No person shall use, enter, be on or remain in the skateboard park after having been notified by the Superintendent of the Parks Department or by the Frankfort Police Department that they must leave the skateboard park or that they are barred from use of the skateboard park as a result of an unsafe use of the skateboard park, or failure or refusal to obey the rules pertaining to the park's use.
   (K)   No person shall enter or exit the skateboard park by any means other than by walking through a gate, turnstile, door, or other means provided and intended by the city for ingress or egress into the skateboard park.
   (L)   No person at, in or on the skateboard park shall violate any rule or regulation developed and adopted by the Superintendent of the Parks Department and posted on signs at the skateboard park or any other applicable rule established by this section.
   (M)   Any person determined by the Chief of Police of the City of Frankfort or his or her authorized designee to have been in violation of divisions (C) through (K), above, shall be subject to citation for an infraction and shall be subject to a fine of $25 for a first violation and $50 for a second or any subsequent violation.  Violators shall be cited to the Frankfort City Court for adjudication of their citation.  In addition to or in lieu of any fine, provided for herein, the Chief of Police of the city or his or her authorized designee may temporarily or permanently bar the violator from using the skateboard park for any violation of divisions (C) through (K), above, or for violation of any rule provided for under division (L), above.
   (N)   The parent or legal guardian having control or custody of an un-emancipated minor whose conduct violates this section shall be jointly and severally liable with the minor for the amount of any fine and court costs imposed pursuant to this section.
