§ 90.03  AT LARGE PROHIBITED; PENALTIES.
   (A)   It shall be unlawful for any owner to allow, suffer, or permit an animal to be at large within the limits of the city.
   (B)   Except as provided in divisions (C) and (D) below, the first violation in any 12-month period shall subject the owner to a fine of $50, a second violation in the same 12-month period shall subject the owner to a fine of $75, and a third violation in the same 12-month period shall subject the owner to a fine of $100.
   (C)   (1)   If, while at large, any animal:
         (a)   Causes injury to a person or domestic animal which is less severe than a serious injury; or
         (b)   Chases or menaces a person or domestic animal without provocation; or
         (c)   Has been determined by the Humane Society to have been at large more than three separate occasions in a 12-month period;
      (2)   Then the animal is declared to be a potentially dangerous animal and the owner shall be subject to the following fines:
         (a)   First violation:  $150;
         (b)   Second violation:  $300;
         (c)   Third violation:  $500.
   (D)   If, while at large, any animal causes serious injury to a human being, then the animal's owner shall be subject to a fine of $500 and the animal shall be declared dangerous.
