§ 90.01  DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ANIMAL.  Any living, non-human vertebrate.
   ANIMAL SHELTER.  The facility operated and maintained by the Clinton County Humane Society, Inc.  for the humane restraining and impounding of animals seized under the authority of this chapter.
   AT LARGE.  Elsewhere than premises under the ownership, control or possession of the owner and either not restrained by a leash, or not under the immediate and complete physical control of a person capable of controlling the animal.
   CAT.  Any domestic member of the feline family of animals.
   DANGEROUS ANIMAL.  Any animal found at large which has:
      (1)   Caused serious injury to a person without being provoked by that person; or
      (2)   Caused serious injury to another domestic animal while at a place other than owner's or keeper's property;
      (3)   Committed a third violation of § 90.03(C) within a 12-month period.
   DOG.  Animals of the Canis familiaris species, and hybrids of a Canis familiaris and any other member of the Canis genus, including wolves.
   EXPOSED TO RABIES.  The situation that exists when an animal has been bitten by or has otherwise been in contact with any other animal known to be, or reasonably suspected of being, infected with rabies.
   HUMANE OFFICER. The Executive Director of the Humane Society of Clinton County, Inc. and any employee of said organization to whom the Executive Director has delegated authority to enforce the provisions of this chapter.
   HUMANE SOCIETY or HUMANE SOCIETY OF CLINTON COUNTY.  A not-for-profit corporation organized under the laws of the State of Indiana, with its principal office at Frankfort, Indiana, whose duties include the apprehension, care and disposition of at large animals.  Herein referred to as the HUMANE SOCIETY.
   OWNER.  Any person, firm or corporation owning or having the care, possession or control of any animal.
   POTENTIALLY DANGEROUS ANIMAL.   Any animal that:
      (1)   Causes injury to a person or domestic animal which is less severe than a serious injury; or
      (2)   Chases or menaces a person or domestic animal without provocation; or
      (3)   Has been determined by the Humane Society to have been at large on more than three  separate occasions in a 12-month period
   PROVOKE. The infliction of bodily harm on the animal or another person, or conduct that constitutes a substantial step toward the infliction of bodily harm on the animal or another person.
   SERIOUS INJURY. Any injury which results in a broken bone, lacerations severe enough to require sutures, or to render cosmetic surgery necessary or appropriate, or death.
