§ 112.02 COMPLIANCE REQUIRED.
   (A)   It is a violation for the owner-occupant of any building, property or premises within the village to dispose of, store, collect, haul or transport, any refuse except in compliance with this chapter.
   (B)   The owner-occupant of multiple residential units, business, commercial or industrial establishments within the village shall make independent arrangements for refuse collection. A special point of pick-up may be approved by the village Department of Public Works Supervisor for each multiple residential unit complex.

§ 112.03 CHARGES FOR SERVICE.
   (A)   The owner-occupant having control over a residential unit shall be charged a user fee at a rate for refuse collection and disposal as established from time to time by resolution of the Village Council as determined by contract with the licensed waste hauler.
   (B)   The charges for refuse collection and disposal shall be billed quarterly by the village. The charge per residential unit is based upon the type of service option selected by the owner-occupant.
   (C)   The owner-occupant may select from the following service options:
      (1)   The bag tag program, which has a charge per tag. Each bag along with its contents to be removed by the hauler must bear a tag. A tag may be used only once. Tags may be purchased from the village.
      (2)   The family program, which allows up to six untagged bags per week to be removed from a residential unit.
      (3)   The cart program, which includes a 90-gallon poly-cart provided by the hauler, plus up to three untagged bags per week.
      (4)   Once per month curbside recycling of materials in a tub furnished by the hauler for designated items, provided that 50% or more of the owner-occupants of residential units subscribe to the service.
   (D)   The village is authorized to collect delinquent refuse collection and disposal charges by adding them to the tax bills and imposing liens against the property of the delinquent owner-occupants in the amounts owed.

§ 112.04 OUTSIDE REFUSE.
   No person who is not an owner-occupant shall bring any refuse into the village and place it in any receptacle, whether furnished by the licensed waste hauler, the village, or by others, nor shall any person deposit, place, scatter, bury or burn any refuse upon private or public property premises within the village, in contravention of this chapter or the fire prevention code, or the nuisance regulations code. Refuse must be pertinent to use of the premises where it is disposed of by the owner-occupant.

§ 112.05 SCAVENGING OF REFUSE.
   No person shall scavenge refuse left for disposal, and no person shall damage or destroy containers of refuse placed for storage.

§ 112.06 REMOVAL OF REFUSE; LICENSE REQUIRED.
   No person shall collect, haul, transport and/or remove refuse from residential units within the village unless such entity has been first issued a license by the village to do so, except that an owner-occupant may remove, or may arrange to have removed by others, construction and/or demolition materials.

§ 112.07 COUNCIL MAY GRANT A FRANCHISE.
   The Village Council shall in its discretion grant a franchise and license to a person, corporation, partnership or firm for the hauling, transporting and handling of refuse from residential units within the village. The Village Council may use the competitive bidding process for such purpose and shall make its selection based upon the capability, performance and bid price offered by the contractor. The village may license the contractor pursuant to a written contract for a term to be determined by the Village Council, and may renew such contract with or without seeking competitive bids. The village may terminate the contract for material breach by the contractor.

§ 112.08 DISPOSAL OF REFUSE.
   (A)   No person shall keep refuse for collection in quantities greater than a week’s accumulation typical of residential units. Refuse of more than one residential unit, or nonresidential unit shall not be brought to another residential unit for collection. Refuse containers shall not be left at the collection site or be visible from the front of the premises on any day other than the collection day.
   (B)   No person shall place construction and/or demolition materials for collection by the village’s licensed hauler. The owner-occupant having such materials shall make other arrangements for their disposal.
   (C)   All refuse must be stored for collection in a container of the type and quality as specified in § 112.09.
