1305.10 ABATEMENT OF NUISANCE; NOTFICATION; POWERS AND DUTIES.
   (a)   The Mayor or the Zoning Inspector shall cause written notice of a violation of Sections 1305.03; 1305.04(a), (c), (d), (e), (f); 1305.06; 1305.07 to be served personally upon the owner, operator, or person having charge of the property involved, or by sending the same by regular U.S. Mail with a certificate of mailing, posting a copy thereof at a conspicuous place on the premises or in the yard attached to a wooden stake. The notice shall state the nature of the public nuisance and the time, not less than five days, within which the nuisance shall be abated. No person so notified shall fail or refuse to comply with the notice. If the public nuisance is not abated within the required time, failure shall be a misdemeanor, and the person shall be subject to the penalties provided in Section 1305.99, and a separate offense shall be deemed committed upon each day during or on which the violation occurs or continues beyond the period contained in the notice; provided that no additional notice of violation is required to be given.
 
   (b)   Any owner, operator, or person having charge of property and having been served with three (3) notices to abate by the Mayor or Zoning Inspector pursuant to division (a), supra, regardless of the type of nuisance or nuisances required to be abated, within a period of 730 consecutive days calendar days from the date of service of the first notice to abate shall have committed a special misdemeanor and subject to the penalties as stated in Section 1305.99(a)(3) regardless of whether any nuisance or nuisances have been abated.
 
   (c)   In administering and enforcing this chapter, the Zoning Inspector shall have the same police powers as are conferred upon the police officers of the City, may serve citations, search warrants, writs, and other legal processes issued by the Municipal Court having jurisdiction over the corporate limits of the City of Fostoria, Ohio, and may enter upon any premises within the City in order to conduct inspections of buildings, structures, and use of land.
