(a) (1) Whoever violates any provision of Chapter 1305 of the Codified Ordinances of the City of Fostoria, Ohio is guilty of a minor misdemeanor punishable by a mandatory fine of not less than fifty dollars ($50.00).
(2) If within one year of the offender has been convicted of, or has pleaded guilty to, one or more violations of Chapter 1305 of the Codified Ordinances of Fostoria, Ohio the offender shall be guilty of a special misdemeanor, punished as follows:
A. A fine up to five hundred dollars ($500.00).
B. The actual cost of abatement of the nuisance by the City.
(3) Whoever violates Section 1305.10(b) of the Codified Ordinances of the City of Fostoria, Ohio is guilty of a special misdemeanor punishable by a mandatory fine of one hundred fifty dollars ($150.00).
(b) Any person who is convicted to one or more violations of Chapter 1305 of the Codified Ordinances of the City of Fostoria, Ohio shall be separately charged a civil penalty by the Zoning Inspector of three hundred fifty dollars ($350.00) by invoice.
(c) Any person served with a notice to abate under this Chapter and fails to comply with such a notice shall be separately charged a re-inspection fee of seventy-five dollars ($75.00) by the Zoning Inspector by Invoice.
(d) In the event a person fails to pay a Civil Penalty or re-inspection fee or costs of abatement to the City of within thirty (30) days of being notified in writing transmitted by regular U.S. Mail, first class by the Zoning Inspector, those amounts may be certified to the County Auditor and placed upon the tax duplicate for collection as a special assessment and thereupon shall be collected as other taxes and assessments; or, the Director of Law may initiate a civil action in a court of law to collect.
