10-1-4: DEFINITIONS:
For the purpose of this title following words and phrases shall have the meanings respectively ascribed to them:
   ALLEY: A strip of land, smaller than a minor street, along the side of or in the rear of properties intended as access to these properties.
   APPLICABLE ELEVATION: The high water elevation applicable to a building, building site or part of a lot, parcel or other area of land shall be the elevation established for:
   A.   The adjoining or nearest stream of other floodgate runoff channel measured at right angles to the general direction of flow in the stream or channel; or
   B.   The adjoining or nearest floodgate detection pond or basin, whichever is the highest.
   BUILDING LINE: A line within a lot or other parcel of land, so designated on the plat of the proposed subdivision, between which and the adjacent boundary of the street upon which the lot abuts, the erection of an enclosed structure or portion thereof is to be prohibited.
   COMMISSION: The Planning and Zoning Commission of the village.
   CROSSWALKWAY: An area, dedicated to public use, which cuts across a block to provided pedestrian access to adjacent areas.
   CUL-DE-SAC: A street having one open end and being permanently terminated by a vehicle turnaround.
   DATUM: All elevations are in feet above mean sea level datum at New York City, or, when so noted on the profile, in feet above the stream bed of the stream or channel or above some other described point or mark in or near the channel 1 .
   DETENTION POND OR BASIN: A land area, so designated, which will detain storm water runoffs.
   EASEMENT: A grant by a property owner of the use, for a specific purpose or purposes, of a strip of land by the general public, a corporation or a certain person or persons.
   HIGH WATER ELEVATION: The highest level of floodgate observed during past floods.
   LESSER CHANNEL: Tributaries which carry water to main channels or streams and which are above the floodplains.
   LOT: A portion of a subdivision or other parcel of land intended for transfer of ownership or for building development.
   OFFICIAL BENCHMARKS: The identifying designation, description, location and elevation of the points or marks constituting a system of official benchmarks are a system of points or marks of known elevations above the mean sea level datum at New York City from which elevations shall hereafter be taken by engineers, surveyors, architects and contractors when making topographical surveys and maps and settings, grades and elevations for buildings, pavements, drainage facilities and other structures or work publicly built or regulated by the village.
   PARCEL: Refers broadly to a lot, tract, or any other piece of land.
   PLAT: A map, drawing or chart on which the subdivision plans of the subdivision are presented and which is submitted for approval first in preliminary then in final form.
   STREET: An area which serves or is intended to serve as a vehicular and pedestrian access to abutting lands or to other streets.
   STREET, COLLECTOR: A street which is designed to carry traffic generated in a neighborhood from minor streets to primary or secondary streets.
   STREET, INDUSTRIAL: A street intended primarily as access to abutting industrially zoned property.
   STREET, MINOR: A street intended primarily as access to abutting properties.
   STREET, PRIMARY: A street of considerable continuity which serves or is intended to serve as a major traffic artery connecting large areas. Such streets will generally have a federal, state or county route designation and interconnect one community with another.
   STREET, PUBLIC: All streets designed on a plat of subdivision as heretofore dedicated or to be dedicated for public use.
   STREET, SECONDARY: A street supplementary to the primary street system providing intercommunication between this system and smaller areas and streets.
   STREET WIDTH: The shortest distance between lines of lots delineating the street.
   SUBDIVISION: The division of land into two (2) or more parcels for the purpose, whether immediate or future, of transfer of ownership or building development, including all public streets, alleys, easements for public service facilities, parks, playgrounds, school grounds or other public grounds.
The following shall not be considered a subdivision and shall be exempt from the requirements of this title:
   A.   The division of land for agricultural purposes into parcels of five (5) acres or more in size which do not involve any new streets or easements of access;
   B.   Sale or exchange of parcels of land between owners of adjacent and contiguous land; provided that such transfer will not affect required setbacks or other zoning ordinance requirements.
   C.   The conveyance of parcels of land or interests therein for use as right of way for railroads or other public utility facilities and other pipe lines which does not involve any new streets or easements of access;
   D.   The conveyance of land owned by a railroad or other public utility which does not involve any new streets or easements of access;
   E.   The conveyance of land for highway or other public purposes or grants or conveyances relating to the dedication of land for public use or instruments relating to the vacation of land impressed with a public use;
   F.   Conveyances made to correct description in prior conveyances;
   G.   Sale or exchange of parcels or tracts of land following the division into no more than two (2) parts of a particular parcel or tract of land existing on July 17, 1959, and not involving any new streets or easements of access. (Ord. O-11-98, 3-9-1998; amd. Ord. O-20-22, 5-9-2022)
